Porter Comes Up With Solution
To Standoff Between Senators

Washington Rep. Charles
O. Porter (D-Ore.) has come
up with what looks like a
solution to the standoff of
last week between Sens.
Wayne Morse and Richard
L. Neuberzer fD-Ore.) over
a bill to give the city of
Roseburg the historic Lillie
Moore property.
Morse blocked Neuberger's
bill which would have con
veyed free the land on which
the 100 -year-old dwelling
house stands. The city got
the house two years ago under
another bill. The free trans
fer violated the "Morse for
mula," the senior senator
claimed, because ihe bill did
not require the city to pay 50
per cent of the appraised fair
l market value of the property.
Neuberger wired the Doug
las County Historical Society
to see if they were willing or
able to put up some $15,000.
which would be half the esti
mated value of the downtown
lot. But Morse said he would
not agree to amend the bill
now and the whole matter
would have to be . put over
until next year.
Drafts Nw Bill
Congressman Porter has
drafted a new bill" under
which the property could be
given to Roseburg free with
out violating the Morse for
mula. It seems there is a law
called the surplus property
act of 1944 which stipulates
that any government - owned
land which the Interior De
partment determines to have
historic value can be con
veyed free to a state, county
or city, providing the govern
ment acquired the land be
fore 1900. . The government

On Sunday
The irony of racing was
certainly evident in yester
day's drag races held at Camp
White.
With a S125 bond posted on
the strip record of 134.21 mph
one would think that torrid
times by the top-seeded drag
ster entries would be the
order of the day but this was
certainly not the case. Once
again these sleek acceleration
machines were plagued by me
chanical troubles that pre
vented them from threatening
the record.
With the addition of an
other $25 Savings bond a sum
of $150 will be waiting for
anyone bettering the mark at
the August 24 meet.
Top time registered in yes
terday's competition was
116.88 mph; rather slow for
a meet sponsored by Southern
Oregon Timing association.
By recording this time and
edging out "Zombie," the
beautiful red and white com
petition coupe built by the
Wheelers Car club of Medford
and sponsored by Medford's
21 club. Noel Black emerged
as top-eliminator of the days
activities.
The Roberts, Mickle, Wiltse
fuel-injected dragster from
Ashland was on hend but
made only three runs before
it was forced out of competi
tion. Its best speed recorded
in a test run was 109.48 mph.
Roberts drove this same drag
ster to a blistering time of
135 mph at Redding, Calif.,
some two months back.
Corvette driver Fred Johns
from Medford established a
new record in "A" class for
American sports cars when
he gunned his Corvette up to
102.06 mph. In. doing so he
broke his own record that he
had established at the last
SOTA drags held at Camp
"White. His old mark was 96.77
mph.

Porter's new bill would
simply remove the proviso
from the surplus property
act, allowing free conveyance
of historic property no matter
when the government got it.
Morse said he thinks favor
ably of Porter's bill, but he
wants to sound out federal
agencies who administer the
law first. Since there is no
chance for enactment of any
bill any longer this session,
with adjournment close at
hand, the new bill probably
won't be introduced until the
first of the next session in
January.
The bill which Morse
blocked had also 'been spon
sored by Porter, as well as
Neuberger. It passed the
House last February. Morse
was able to block it in the
Senate because, being a minor
bill, it was called up under
a limited debate procedure
known as the consent calen
dar. Those bills that gain un
animous consent are passed,
those to. which" any senator
withholds his consent or ob
jects are not passed.
Power to Block Bills
Because these property con
veyance bills are rarely if
ever brought up under unlim
ited' debate procedures which
provide for a majority vote,
one senator in this case
Morse has the power to
block them by simple objec
tion. This procedure has given
Morse the 'power to insist on
the Morse formula, for no
other senator can get a prop
erty conveyance bill passed
plus the final to rack up 2,000
points and a record speed
mark of 103.481 miles per
hour for the 90-mile grind.
This will go in the record
books along with her mark of
186 mph for a measured mile.
Miss Thriftway, the defend
ing champion, crashed into a
Coast Guard picket boat on
the first turn of the second
heat, injuring driver Bill
Muncey and ' two Coast
Guardsmen. They were taken
to a hospital with cuts and
bruises, but Miss Thriftway
and the picket boat went to
the bottom.

Morse is present unless it con
tains the formula. .
The formula is that if the
property is to - go for some
public park or recreation
grounds or other public use,
the recipient must pay 50 per
cent of its fair market value,
and if for private or commer
cial use, the recipient pays
100 per cent. Morse started in
sisting on it after World War
II when he found a number
of bills rolling through that
made "a grab bag" out of fed
eral property.
"Too many members of
Congress saw a chance to
strengthen themselves with
their constituencies by intro
ducing bills to have the fed
eral government give their lo
calities or their states federal
property," explained Morse.
Saves Taxpayers
He estimates his insistence
of part or total payment has
saved the taxpayers millions
of dollars over the years.
Neuberger and Porter have
no objection to the Morse for
mula, but they thought it
didn't apply to the Lillie
Moore bill because Morse has
generally not applied it in
cases where the government
was turning it back to those
who donated it to Uncle Sam
originally. The Library of
Congress offered the same in
terpretation. The government
has already realized $161,000
from lease and sale of other
property donated by Miss
Moore.
Chides Morse
But Morse said this was not
a case of turning the property
back to the original donor. He
said Lillie Moore willed it to I
the government with no
strings attached, and now if
local citizens wanted it back
for a museum they ought to
pay 50 per cent. Neuberger
countered with affadavits
which indicated Miss Moore's
dying wish was that it be
come a museum. Morse retort
ed that he knew his law of
wills, having taught it for
years at the University of
Oregon, and nothing outside
the language of the will was
admissible.
Neuberger chided Morse for
having failed to object to con
veyance of the Moore, house
free in 1956 under another
bill. He said he didn't see
how Morse could now object
to conveying the land on
which it stands. Morse replied
the house was "valueless" but
the land was valuable real es
tate in the downtown section
of Roseburg.
By implication, Neuberger
was"- suggesting that Morse
hadn't been consistent when
he failed to apply the Morse
formula to conveyance of the
Moore house to the city. He
charged that Morse's formula
is flexible, "it expands and
contracts like an accordion."
Taking the Senate floor to
defend himself next day,
Morse said:
"The provision for the grat
uitous transfer of the house
was inserted on the House
side. I was not here on the
day the House-amended bill
was submitted to the Senate
I knew nothing about the
gratuitious transfer of the
house."
More Cosily
He added that he under
stood the house "would have
been more costly to the fed
eral government to remove
than to give away."
The Moore house was full
of antiques, from Boston and
Victorian rockers to rare gold
and silver coins.
The Congressional Record
for July 25, 1956, day the
Senate passed the bill to con
vey the house, shows that
Morse was present that day,
answered several roll calls
introduced a bill on multiple
sclerosis, made a brief speech
on disarmament and . com
mented on various other
topics No senator raised any
questions on the Moore house
bill.
In any event, whether
Morse or Neuberger is right,
the pending bill is dead. And
Porter's proposed new bill
offers a solution that could
fulfill the wishes of the late
Miss Moore, the Douglas
County Historical Society and
Sen. Morse and still not cost
the local citizens any payment
to Uncle Sam.

Hoover Observes
84th Birthday

Former President Herbert
Hoover, one of the nation's
most active octogenarians,
celebrated his 84th birthday
anniversary Sunday with no
sign of letting up in any of
his manifold activities.
While congratulatory tele
grams poured into his . Waldorf-Astoria
hotel suite from
throughout the world, Hoover
spent the day with his son,
Allan H. Hoover, and his son's
wife and children at the
younger Hoover's home here
30 miles from New York.
During a news conference
at his New York apartment on
Saturday, Hoover went on
record for limiting former
presidents to a seven-day, 12-hour-a-day
work week and 15
minute speeches.
Hoover, jovial and chipper,
unveiled an impressive array
of statistics for people inter
ested in what a "retired" for
mer president does.
He said he received 1,620
invitations to speak last year
and delivered "nine major
speeches and 21 minor speech
es." And, he noted, he travel
ed a total of 19,952 miles by
air and about 3,000 miles by
automobiles.
The nation's 31st president
disclosed his office staff which
numbers four secretaries and
a researcher, replied to 55,
952 letters in addition to
birthday, Christmas or speech
acknowledgements.
Italians Claim
Oldest Horse

tina is a new arrival among
Italy's horsey celebrities, but
her claimt o fame may never
be established.
It is obvious, just by look
ing at Titina on her wobbly
legs enjoying a bask in the
morning sun, that she does
not care whether she is fam
ous or not.
But a group of Titina fans
here do care. They claim she
is 55,' the oldest horse in the
world, and they want to add
the title to the one they have
already given her the most
lovable horse in the world.
Titina comes from the fam
ily of Hoennisland horses, na
tives say, and was bought in
1906 at the age of three for
exhibition at the Verona fair.
Her owner was Count Gianni
Cavazza of Modena. After the
fair . he brought her to his
villa park at the little suburb
of Solara on the outskirts of
Modena. "
Count Cavazza made Titina
the mascot of Solara at the
disposal of all the village
school kids. That's what she's
been ever since.

Echo Woman Dies
In Car Accident
Hermiston (UPD A 26-year-old
Echo, Ore., woman,
mother of two, was fatally in
jured Sunday afternoon when
the car she was driving left
Highway 207 about eight
miles south of Buck's Corner
and overturned.
The woman, Mary Margaret
Maynard, died in a Hermis
ton hospital about an hour
and a half after the one-car
accident.
A passenger, Mrs. Mary
Ellen McEwen, was reported
in serious condition in the
Hermiston hospital with rib
fractures, and undetermined
head- injuries.
Mrs. Maynard's two chil
dren, who were also pass
engers in the car, were treat
ed at the hospital and re

Americans Bilked

investigators reported Sunday
night overweight Americans
are being bilked of 100 mil
lion dollars annually by using
alleged reducing preparations
which do not actually trim off
any fat.
They said manufacturers of
a variety of candy wafers, re
ducing machines and drugs
push products by telling fat
