Caryl Chessman Gets
Hearing Next Fall

Washington ttJ.R) The Su
preme Court has granted a hear
ing to convict - author Caryl
Chessman, who has held off exe
cution for nine years by his legal
maneuvering from his San Quen
tin Prison death cell.
The court acted on Chessman's
ninth petition for review. Argu
ments on the case will be sched
uled tome time next fall. Later
the court will deliver a written
opinion.
Said Denied Rights
The 36-year-old convict, once
known as the "lover's lane ban
dit of Los Angeles," contended
he wag denied his constitutional
right to "due process of law"
in the lower courts.
California Attorney General
Edmund G. Brown countered
that Chessman's petition was
"one of the most scurrilous and
misleading" ever to come to his
attention.
The last round in lower courts
was ordered by the U.S. Su
preme Court Oct. 17, 1955, to de
termine whether fraud occurred
in preparing the stenographic
record of the original trial. The
shorthand reporter died shortly
afterward and his notes were
transcribed by a substitute.
Chessman contended the sec
ond reporter fraudulently col
laborated with the prosecution.
He said the record omitted an er
roneous instruction to the jury
by the judge.
Federal Judge Upheld
In hearings in San Francisco,
Federal District Judge Louis E.
Goodman found no fraud. He
wag upheld Oct. 18, 1956, in a
2 to 1 decision by the Ninth U. S.
Circuit Court of Appeals.
Chessman also sought an order
in Goodman's court to establish
title to an unpublished novel,
"The Kid Was a Killer." The
manuscript had been seized by
the prison warden, he said.
The condemned man won fame
by writing two other books en
titled "Cell 2455 Death Row,"
a best-selling autobiography, and
"Trial By Ordeal." He was con
victed in 1948 on 17 felony
charges.
They included kidnaping for
the purpose of robbery, grand
theft and attempted rape. He
was the first man doomed under
California's "Little Lindbergh"
law for kidnapping with bodily
harm.
Idaho Arson Trial
Enters Second Week
Moscow, Idaho (U.P.) The
murder-arson trial of Paul D.
Matovich entered its second
week Monday as prosecuting at
torneys continued to present
their case.
A jury of nine men and three
women was hearing the case of
the University of Idaho fresh
man accused of setting campus
dormitory fires, one of which
killed three fellow students.
Last week the prosecution
caled on 22 of its list of 50 wit
nesses to testify in establishing
causes of the fires and deaths.
Sessions were held Saturday to
speed the trial.

Tokyo (U.R) Unusually
strong radioactivity was detect
ed in rain which fell on south
ern Japan this week end and
weather officials said today it
was caused by a nuclear test
held somewhere "recently."
Officials said they did not
have enough scientific proof to
attribute it to the Soviet's latest
experiment announced by Brit
ish and the United States last
week.

school recently was a piano
given by Mr. Servard. The piano
was originally given to the two
Servard boys by Mrs. Jim White,
before her death.
Several miners have started
working their claims in the
Meadows area.
Mrs. Anna Minick is visiting
for a few days at the home of
Mr. and Mrs. Lloyd Beers. Mrs,
Minick is Mrs. Beer's aunt.
Don Terry has returned from
Portland after visiting there for
a couple of weeks. His thumb,
which he cut while working in
the mill, has improved.
Allen Hill, who is a mission
ary of the Union Sunday school,
made a hurried trip to Califor
nia recently because of the ill
ness of his mother.
Mrs. Lloyd Beers accompan
ied her mother and father, Mr.
and Mrs. Charles Sanderson, of
Sams Valley, to Portland for a
week's visit. . ,
Mrs. Guy Bishop left Monday
for Pullman, Wash., for a few
weeks visit with her son and
family. ,
The wild flowers in the Mead
ows area are very pretty this
spring due to the late rains. Last
Saturday morning, mixed snow.

Funeral services were held on
Saturday morning at Conger
Morris funeral home in Medford
for Austin Becker, who passed
away in that city Wednesday
night. Becker resided for many
years in the Colestine area near
Hilts. He was 85 at the tune of
his death.

Fliers Escape Serious
Injury in La pine Crash
Bend (U.R) A light plane
carrying two Spokane, Wash.,
area ranchers crashed while at
tempting to take off from the
Lapine airstrip Saturday but
both escaped serious injury.
J. W. Culler, the pilot, suffer
ed facial injuries while O. E.
Smith, his passenger, apparently
was not injured. Both were
brought to St. Charles Memorial
hospital here by Frank Clark of
Lapine.
Clark said the plane appar
ently was caught in a downdraft.
