area. Full bloom period should be reached
by mid-week, but tours are suggested for this
week end and next week end. There are more
than 10,000 acres of pears in the Medford
Ashland district.

Contesfed in Petition
McMinnville (U.R) A will
which would leave the bulk of
an estate appraised at about
$500,000 to two organizations of
the Catholic church is contested
in a petition filed with the Yam
hill County Court Friday.
The will is that of Mrs. Kath
erine M. Connor of Dayton, Ore.,
who died last September. The
petition was filed by her step
daughter, Mary Connor Meyer
of Los Angeles.
Under terms of the will, aft
er payment of about $40,000 to
various beneficiaries, the balance
was to be divided between the
Catholic Near East Welfare as
sociation and the Society for the
Propagation of the Faith of the
Roman Catholic Archbishop of
the Archdiocese of New York.
About 350 different crops are
grown on American farms.

Blossom Route Set
For Pear Festival
Early blooming date of pears
in the Rogue valley this year
has prompted announcement of
the Pear Blossom route as a
pre-festival event, according to
festival officials.
The map outlining the route
follows the pattern established
last year, and is published for
the convenience of those not fa
miliar with the location of the
larger orchard areas.
D'Anjou pears are approach
ing full bloom this week end,
and other varieties will reach
the peak of bloom about mid
week, according to C. B. Cordy,
county horticulture agent. He in
dicated a tour of orchard area in
the vicinity of Table Rock would
be colorful this week end, but
that the most ideal time to take
the full tour would be about
Tuesday or Wednesday. Enough
bloom on late varieties of pears
will still be in evidence the fol
lowing week end to make anoth
er tour worthwhile, Cordy said.
Festival officials said markers
have been prepared and were to
be placed on stakes along the
route in time for use today. It
was pointed out that a drive in
almost any area of the valley
would take those interested to
orchards which make up the
more than 10,000 acres in the
Medford district.
Speaker Scheduled at
Free Methodist Church
The Rev. W. S.Kendall, super
intendent of the Oregon confer
ence, will speak at the Free
Methodist church, Tuesday
through Thursday.
He will speak nightly at 7:30
p.m. at the church, 1266 South
Peach street. He has announced, ;

mings accepted the city council
leadership Thursday night from
retiring mayor Matthew Mc
Neil. Cummings was elected mayor
by acclamation after being nom
inated for the post by Harry
Friedman, city councilman.
Cummings praised McNeil on his
leadership during past months
and declared the mayor had
faced "many hard decisions."
Milk Producers Reelect
Westerberg President
Salem Richard Westerberg
of Ashland was reelected presi
dent of the Oregon Milk Pro
ducers association Thursday
night at the association's annual
meeting.
Lester Adams, Applegate, was
reelected manager. The board
of directors unanimously agreed
to support the milk usage audit
measure, House Bill 495.

Municipal Judge Prepares Paper
Explaining Rights of Defendants
Persons charged with violat
ing some law appearing before
the Medford municipal court
will now be advised of their
rights in court from an ex
planation prepared by Munici
pal Judge Noreen Kelly. It will
be made available to defendants
starting Monday.
The report explains to those
charged their rights and duties
in court, implications of their ac
tions and plea in court and their
right of appeal and representa
tion. Miss Kelly pointed out an ex
planation of "rights in court"
was formulated for Medford aft
er a similar report had been pre
pared for the Salem municipal
court. She said the Salem report
was prepared after controversy
developed there that the munici
pal court was no more than a
"kangaroo court."
The explanation of rights is
as follows:
"You are here today in re
sponse to a charge of violating
some law. This is possibly your
first experience in court and it
is desired that you be fully ad
vised of your rights .and duties,
and that every person who comes
here receive fair consideration
and impartial treatment in con
formity with the highest ideals
of American justice.
Charges Read
"When your name is called,
come forward to a position fac
ing the Judge. The Judge will
read to you the charge against
you and will ask whether you
plead 'guilty' or 'not guilty'
to the charge. You have the right
to consult your attorney before
entering a plea. If you do not
fully understand the complaint,
you may ask to have it explain
ed to you.
When you say 'guilty,' it is
the same as saying 'I did vio
late the law as charged in the
complaint.' When you say 'not
guilty,' it is the same as saying,
General Hargreaves
To Speak This Week
Maj." Gen. John M. Har
greaves, meaical advisor to the
Oregon State Civil Defense, will
discuss "Atomic Medicine" be
fore health and medical groups
in Medford and Camp White on
Wednesday night and Thursday
noon.
General Hargreaves, who is re
tired from the Air Force, has
been chief surgeon of the Air
Force, and was medical chief for
the Far East Air Forces during
the Korean conflict.
He will speak at a dinner
meeting of the Jackson County
Medical society at 7 p.m. Wed
nesday, Apnl 10, at the Veterans
Administration Domiciliary cen
ter, Camp White.
More than 60 Jackson county
physicians and surgeons are ex
pected to attend the meeting and
inspect a mobile army surgical
hospital,- which will be on dis
play, according to 3r. Wallace
J. Pianka, chief medical officer
of the VA domiciliary.
The unit, capable of being
transported on a truck, may be
inspected by the public while
it is at the Camp White station,
between 2 and 4 p.m. and 7 and
9 p.m. Thursday and Friday at
building 217, Dr. Pianka said.
The retired major general also
will discuss atomic radiation fall
out at a noon luncheon meeting
of the Jackson County Public
Health association Thursday,
April 11, in the Pioneer Room
of the Jackson hotel.
Mrs. Henry Padgham, associ
ation president, said the public
has been invited to the no-host
luncheon.

charged in the complaint."
When you plead 'guilty,' an
immediate hearing is held and
you will be given an opportunity
to state any facts or extenuating
circumstances concerning the
case that you may desire the
Court to know. You have ad
mitted that you violated the law
and all that is required is an in
formal hearing of all the cir
cumstances before the Judge
pronounces the penalty:
"When you plead 'not guilty,
you are entitled to a formal trial
to establish the facts. The mat
ter will be set for trial at a later
date, at which time the burden
will be upon the city of Med
ford to establish the truth of the
charge against you. In every
case, there is a presumption of
law that you are innocent of the
charge until competent evidence
proves otherwise, or you enter
a plea of 'guilty,' admitting the
charge. You are entitled to have
a lawyer represent you. Under
a plea of 'not guilty,' the Court
will fix bail, which must be post
ed to guarantee your appearance
at the time of trial. r
Case To Trial
"When your case comes to
trial, the burden of proof will
be on the prosecution whose wit
nesses will appear first and tes
tify under oath as to the alleged
facts. You (or your attorney)
may question each witness upon
the matter about which he has
testified. When the prosecution
has finished, you and your wit
ness may testify to your version
of the facts. As the defendant,
you have the right to' decide
whether or not you wish to tes
tify yourself; you will not be re
quired to do so. If you do, you
must answer any proper ques
tions the prosecution may ask
concerning the matter about
which you have testified. After
all the evidence has been heard,
you have the right to present
your brief argument to the Court
if you wish. The Judge will then
decide, from the evidence prop
erly heard in Court, whether
you are 'guilty' or 'not guilty'
of the offense against you. The
complaint will be dismissed if
you are found 'not guilty,' if
you are found 'guilty' the pen
alty will then be pronounced.
"If, after trial, you are not
satisfied with the Judge's deci
sion, you may appeal the case
to the Circuit Court if the pen
alty imposed includes any Jail
sentence or when the fine is
more than $20.
"Every person has the right
to make his own defense, with
out counsel, but if you are in
doubt as to the-proper course,
it is recommended that you con
sult your lawyer.
"Neither the police officer,
the city attorney, the judge nor
the clerk gets any part of your
fine. They are paid a salary and
it makes no financial difference
to them whether you are fined
or not."
