sorry. To him people were just
so many animals.
This is exactly what one would
expect. Usually these people
seem to have been born without
any sense of responsibility,
shame, decency or purpose in
life. They are like mischievous
children who do whatever they
want to d6, regardless of con
sequences. They swindle, they
forge checks, they steal cars,
they marry women and desert
them they do anything that
will get them a few dollars, and
they cannot feel sorry.
What is curious is that be
cause of our stupid, outmoded,
futile, and unworkable laws de
fining insanity, these people, no
matter how '"crazy" they may
be in the eyes of their family,
their acquaintances, and their
physicians, have to be adjudged
sane. Why? Because they can
tell right from wrong; they can
appreciate the consequences of
their behavior; and they have no
hallucinations or delusions. No
mental hospital superintendent
can hold them for a day. Be
cause their crimes are usually
petty, no jail holds them for
more than a few months. Then
they come out and get into mis
chief again.
Mentally Unbalanced
Recently, I read the to me
unintelligible instructions of an
able judge to a jury telling them
how they were to decide whether
brutal murderer was sane or
insane at the moment when, dur-
ng a hold-up, he needlessly kil
led his victim. As I remember,
the psychiatrists who had ex-
mincd the man had said he had
lways been mentally unbal-
nced he had even been for a
time in a mental hospital but
they could not help the judge
because thpv had no wav of
knowing if, when he pulled the '
trigger, he knew right from
wrong, etc. Accordingly, the all
important question, on which ex
perts would not and could not
express an opinion, was put up
to 12 men and women who knew
nothing about insanity. In order i
to help them, the judge wrote I
out careful instructions defining
the old law of insanity. I was
impressed by the fact that, with i
all my special knowledge in this
field, I could not understand the
document, and if I had been a !
juror in the case, I would not
have known what to do.
Should Protect Society !
How wonderful if the judge
and jury and lawyers, instead
of playing a stupid game accord
ing to ancient and outmoded
rules, and instead of worrying
only as to whether they should
punish the fellow, had thought
about ways of protecting society
permanently from this mad-dog
type of man. How wonderful if
the fine judge could have said
to the jury, "Here's the problem
in a nut-shell. Here we have a
man of 35 who has always been
mentally unbalanced, always un
able or unwilling to hold a job;
always living by stealing or rob
bing, and perfectly willing to
kill anyone. Obviously, your first
duty to society is to order that
this fellow be either executed or
locked up for life. But now re
member; if you say he was in
sane he will have to be locked
up in our old state mental hos
pital, which was built about 1850
and is not constructed or run in
such a way as to hold a danger
ous and shrewd and murderous
fellow like this. From such a
hospital he will soon escape,
and then this process of catching
and judging him will have to
be gone through all over again

rights and his good; let us not

he will surely be robbing and
perhaps killing when he gets

the doctors here have no illu
sions that by any treatment any
one can ever make this man into
a good citizen who can be trusted
with freedom."
Judge Felt Distressed
Why cannot our lawyers and
judges have sense enough to talk
like that? Why must we often
spend three months convicting
or turning loose a murderer
about whose guilt there can be
no reasonable question? Why do
we play such a stupid and very
expensive and time-consuming
game?
Some years ago as I waited to
testify in a trial, I marveled as
the judge ruled out practically
every bit of evidence that would
have shown what the case was
all about. I gained the impres
sion that the judge was a fine
man who felt a bit distressed
over the sorry part he was play
ing. Unlike a British judge, he
made no effort to learn why the
litigants were there; all he did
was to see to it that the opposing
lawyers played their silly game
according to the rules.
Dr. Alvarez hopes his readers
will understand that it would be
impossible for him to answer re
quests for information or to at
tempt to diagnose by (mail.
