each ol them, be forever debarred
from asserting any claim whatever In

AN ORDINANCE declaring the
assessment on property benefited tor
the cost of constructing paving,
curbs and driveways on North Keene
Way Drive from Jackson Street to
Oregon Avenue in the City of Med
ford. Oregon: and directing the Re
corder to enter a statement thereof
in the docket of City Liens and pub
lish a notice thereof as required by
the Charter.
THE CITY OF MEDFORD DOTH
ORDAIN AS FOLLOWS:
Section l! WHEREAS, the City
Council did heretofore by Ordinance
declare its intention to construct
paving, curbs and driveways on North
Keene Way Drive from Jackson
Street to Oregon Avenue in the City
of Medford. Oregon; and to assess
the cost thereof upon each lot or
part thereof adjacent to the bene
fited by such improvement its pro
portionate share of the cost of said
improvement, and did fix the time
and place for hearing protests against
the construction of said improvement,
and the assessment of the cost there
of, as aforesaid; and
WHEREAS said Ordinance was duly
posted and published as required by
the Charter of the City; and
WHEREAS a meeting of the Coun
cil was held at the time and place
fixed in said Ordinance for the pur
pose of considering any such protests,
but no protests were at such time, or
at any time, made to, or received by
the Council to the construction of
said improvement, or the assessing
of the cost thereof, as aforesaid, and
said Council has considered the mat
ter and deeming that said construc
tion of said improvement was and is
of material benefit to said City, and
that all the property to be assessed
therefor will be benefited thereby
to the extent of the probable amount
of the respective assessments to be
levied against said property, did order
the construction of said improvement;
and
WHEREAS, the cost of said im
provement has been and hereby is
determined to be the sum of $7,167.01,
NOW THEREFORE, it is hereby de
termined that the proportionate
share of the cost of construction of
said Improvement, on each parcel of
property adjacent to said improve
ment and benefited thereby is the
amount set opposite the description
of each piece or parcel of land below,
and that each piece or parcel of land
is benefited by the construction of
said Improvement, to the full extent
of the amount so set opposite such
piece or parcel and that the respec
tive amounts represent the propor
tional benefits of said improvment
to said respective parcels of prop
erty, and the Council does hereby
declare that each of the parcels of
property described below is hereby
assessed the amount set opposite each
respective description, for the cost
of the construction of said improve

water main on Marie Street from
Saling Avenue to Jackson Street and
on Jackson Street from Marie Street
to Madison Place and on Madison
Place from Jackson Street to the al
ley between Jackson Street and
Queen Anne Avenue in the City of
Medford. Oregon, and to assess the
cost thereof upon the property front
ing on said portion of said streets in
proportion to the frontage of said
property.
