THE CITY OF MKDFORD DOTH
ORDAIN AS FOLLOWS.
Section 1. Whereas the City of
Medford did heretolore cause to be
constructed and laid a water in m
Murphy Road from a point 4.8 feet
North of Barnett Road to Walden
Place and adjacent to certain real
property in the Citv of M'dford
fronting on Murphy Road and the coat
of said water main hits not been paia
nd the Council i of the opinion that
said water main may be uxed by trie
propertv fronting on said Murphy
Road wherein said water main has
been laid as a lateral water main
without materially interfering with
the use thereof for the purpose lor
mch it was ortginallv laid and:
WHEREAS the Council did. after
aid water main was laid, declare, by
resolution. ita intention to assess the
pcopertv fronting on said Mdrphy
Road within which said water main
was laid and which it proposed to per
mil the owners of adjacent property
to use for lateral water main pur
poses and did. in said resolution, des
ignate the amount per front foot
which it proponed to assess against
aaid adjacent property and.
WHEREAS said resolution was duly
posted and published as required by
the Charter, and whereas a meeting
of the Council was held at the time
and place fixed in said resolution for
the purpose of considering any pro
tests against said assessment, but no
protests were made at such time or
at anv time thereto and the Council
having considered the matter infl
deeming that the use of said water
wain for lateral purposes, as aforesaid.
Is of material benefit to the said City
and that all of the property to be
assessed therefor will be benefited
therebv to the amount of the assess
ment herein levied against the same.
'"WHEREAS the Council has determ
ined that the sum of SI! 25 per front
foot Is a proper and reasonable amount
to be assessed against the property
frontinr upon the road within which
said water main waa laid, now there
fore each parcel of property herein
after set forth and described is here
by found to be benefited by the use
of said water main as a lateral water

Section 1. That it is the Intention
of the Council to cause paving, curbs
and driveway, to be constructed on
Murrav Street from the end of the
existing pavement thereon to Colum
bus Avenue in accordance with the

and specifications on file in the office
of the Cttv Manager, at the City Hall.
Medford. Oregon, to which plans and
specifications reference is hereby
made for details snd estimated costs
thereof, and to assess upon each lot.

improvement as provided by the Char
ter of the City of Medford.

fore said Council and show cause, if
any, why said Improvement should
not be constructtd, and why aaid
propertv should not be assessed lor
the construction thereof.
Section 3. That warrants for the
coat of the aforementioned improve
ment shall hear interest at four per
cent ' 4 per annum and shall con
stitute general obligations of the City
of Medford. and said warrants shall
be issued pursusnt to. and on the
