Motion Filed to
Dismiss Complaint
Portland (U.R) A motion
challenging the legality of the
present Multnomah county grand
jury was filed here Friday by
Attorney James M. Hafey. The
motion, if granted by the court,
could upset pending grand jury
action on many criminal indict
ments and nullify the vice and
corruption indictments returned
recently.
Hafey asked for dismissal of
a criminal complaint against his
ciient. He based his move on
three points which 'included a
charge that the present or suc
ceeding grand juries cannot re
turn valid indictments because
the 1956 jury list was not select
ed from both the assessment
rolls and voter registration rolls
from all parts' of the county in
proportion to all qualified jurors
appearing on those two rolls as
required by statute.
He also said the June 1956
grand jurors were not examined
individually by the jury com
missioner and that prospective
jurors were excused by persons
other than the presiding judge.
Howard R. Lonergan, chief
criminal deputy district attorn
ey, filed a cross motion asking
the court to set all pending
cases over to the September
grand jury. He said the motion
would be litigated before any
more cases are presented.
County Clerk Si Cohn said
the voter list only is used be
cause it is a much more satis
factory list to work from. He
added, "The law, so far as I
know, reads that the jury list
can come either from the tax
payers or from the registered
voters, or both."
Tooze, Walker Said
In Fair Condition
Salem (U.R) Two Oregon
judges were reported in fair con
dition in Salem Memorial hos
pital today.
Justice Walter L. Tooze of the
State Supreme Court and Cir
cuit Judge Arlie Walker of Mc
Minnville are both receiving
treatment for heart ailments.
Judge Walker was stricken
while attending a Kiwanis con
vention here last Monday, and
Justice Tooze was received at
the hospital about two weeks
ago.

Educator, Author Dies in Ashland
Ashland Tenjas Henry
Schutte, 72. of 769 South Moun
tain ave., Ashland, long-time ed
ucator and author, died in Ash
land Thursday evening after an
illness of several months.
Mr. Schutte was born Oct.
1, 1883 at Wflsonville, Ore., and
was married to Emma Cruse at
Energy, 111., June 8, 1910. He
received his bachelor's degree
and master's degree at the Uni
versity of Illinois and his doctor
of philosophy degree at the Uni
versity of Chicago.
School Positions
He was a school principal in
Minnesota, superintendent of
Oregon College of Education at
Monmouth, Ore., superintendent
of the Methodist Women's col
lege in Montgomery, Ala., visit
ing professor at George Wash
ington university in Washington,
D.C., Miami university and Duke
university in North Carolina and
dean and director of education
at New Mexico Western college.
He was the author of three
books and several magazine art
icles on education.
Church Member
Mr. Schutte was a member of
the First Methodist church of
Ashland and a life member of
Oak Park Masonic lodge 864,
Montgomery, Ala.
Survivors include the widow,
Mrs. Emma Schutte, Ashland and
a brother, Elmer Schutte, Sher
man, Tex.
Funeral services will be held
at 2 p.m. Tuesday at Litwiller's
Mountain View chapel in Ash
land. The Rev. B. J. Holland of
the Presbyterian church will of
ficiate in the absence of the Rev.
Ross Knotts, Methodist pastor
who is out of town. Interment
will be at Mountain View cem

Dors, England's blonde bomb
shell version of Marilyn Monroe,
exploded Sunday night in a sav
age attack on a United Press
photographer covering a lavish
filmland party at her $175,000
estate.
The British actress joined her
husband, Dennis Hamilton, in a
wild, kicking, hitting attack on
photographer Stewart Sawyer,
32, who they accused of pushing
them and two others into a
swimming pool.
Acted Like Tiger
Witnesses said Hamilton acted
"like a tiger" as he knocked
Sawyer to the ground and sat
on him, beating his bloody face
while Miss Dors screamed "un
printable words" and kicked at
the photographer's head.
Sawyer was carried from the
side of the pool, unconscious and
bleeding after guests pulled the
enraged husband away. Sawyer
reportedly suffered a broken
nose and bruises on his head,
face and ribs.
When he regained conscious
ness, Sawyer denied pushing the
actress, Hamilton, agent Louis
Shurr and wardrobe designer
Howard Shoup into the pool.
The mild mannered phbtogra
pher was to undergo a medical
examination later today. His wife
Jan, said his nose was "puffed
up like a balloon."
"He definitely was hit from
behind," she said. "He's got a
lump on his back. He also was
injured on his forehead and
cheek. He's been badly beaten."
To Depend on Results
Mrs. Sawyer said the possi
bility of any legal action would
depend on results of the medical
examination. "My husband has
no plans right now for anything
except getting some rest and
then seeing his doctor," she said.
Sawyer said he was a bystand
er in the episode.
"I did not push them into the
pool nor do I remember any
thing except both Miss Dors and
her husband attacking me," Saw
yer said.
Hamilton, a former profession
al fighter, said after he had
changed into dry clothes, "I
haven't given this man (Sawyer)
my calling card yet. This man
hasn't been dealt with yet."
Judges Announced
For Horse Show

Oregon State Fair horse show
were announced Saturday by

The horse show is being resum
ed after a lapse of several years
and will be presented nightly at
