of Lane county against a writ
previously directed to him.

owner and operator of a shoe
shine stand delivered the bacca
laureate sermon at East High
School this year. The president
'of the graduating class was the
speaker's son, Frank Cleveland
Jr. ,
When the Rev. Frank Cleve
land Sr. told the members of the
graduating class to continue their
education in npite. of obstacles
and hardships he was a living ex
ample of his sermon. The 43-year-old
minister, who obtained
his own high school degree only
last spring, runs a shoe shine
parlor to finance not only his
own education but that of his
sons.
He will enter Capital univer
sity this fall in quest of a de-
.' gree.
Cleveland Sr. was born in
"Louisiana. His father died three
months before he was born.
Frank then began shining shoes
to help his mother.
He came to Columbus 18 years
.ago, working as a porter and
-riveter, then married and be
came a deacon in the church. In
he entered the ministry
and was ordained in the Mis
sionary Baptist Church.
- Determined to get an educa
tion for himself and his sons,
for which preaching did not pro
vide enough income, he turned
: to shining shoes again. So far
this has provided the necessary
educational financing.
Frank Jr. will join his father
at Capital university.
The younger Cleveland was
awarded scholarships totalling
$800 by Capital university for
proficiency. He also won the
Duke and Duchess Club of
'America $100 scholarship, has
been cited by the Ohio Music
Education association as an A-l
Music student, and was chosen
as tht most outstanding student
in music and for citizenship at
East High.
the April grand jury which he
charged had been improperly
drawn.
The majority opinion, written
by Justice Earl C. Latourette,
held that on May 9 Circuit Judge
Dal M. King of the same judicial
district overruled the district at
torney's motion to discharge the
grand jury.
J is'ticc Latourette declared
that every lawyer should know
"our ruling on the demurrer is
not a ruling on the truth or fal
sity of the allegations found in
the writ respecting the conduct
of Judge Reid. Every lawyer
should also know that nothing
here is said as to the merits of
the controversy and that our
action in the premises does not
foreclose a proper inquiry when
brought in a proper proceeding
against the proper parties."

Majority judges in the case in
addition to Latourette were
Chief Justice Harold Warner and
Justice Walter L. Tooze and
William C. Perry.
On behalf of the minority. Jus
tice Hall S. Lusk filed a short
opinion in which he was joined
by Justices George Rossman
and James T. Brand. . Justice
Lusk said that this is a lawsuit
between the slate of Oregon as
plaintiff and Judge Reid as de
fendant. "It is this court, not the
defendant judge that is asked to
determine the question whether
the grand jury for Lane county
is an illegal one," the minority
judges held.

winter sets in take a test of your
garden soil.
The test will get your garden
off to a faster start next spring,
says Norman Oebker of the Un
iversity of Illinois. To take the
test:
Dig spade-depth holes at
about eight scattered spots in
the garden. Take a thin slice
from the side of the hole all the
way from top to bottom. Let the
soil dry out in an ordinarily
heated room. Then mix the eight
slices together and send about
half a pint of the mixture to a
soil testing lab, such as the one
at the University of Illinois,
where-tests are run for a $1 fee.
Be sure to tell the lab what the
soil will be used for next spring.
