mine which of two women is his
legal wife and entitled to
share in the income from the sale
of his Curry county timber.
The bank brought suit against
Thornton and his present wife,
Ruby E. Huber, whom it said he
married at Skamania March 16
1956.
Ruby E. Huber last week filed
suit against him for separate
maintenance on charges of gen
eral acts of cruelty through her
attorney. O. H. Bengtson, of
Medford.
Bengston said the second Mrs
Thornton is asking the court for
possession of his house, automo
bile, furniture and $800 a month
living expenses, since she alleg
es she is unable to do physical
labor. She is also asking the
court $2,500 In court and attor
ney fees, Bengtson said.
Declared Incompetent
The Portland Trust bank, how-
ever, contended the marriage
was not legal on the ground
Thornton had been declared in
competent by Eureka, Calif., au
thorities, that his present wife
knew of the declaration, and that
she married him while it was in
effect.
It also contended in the suit
that Thornton was married to
Ida Whipple July 9 ,1931, at Gold
Beach, that they had five chil
dren, four of whom are living
and that they were not divorced
They were reported to have been
separated for some time.
Th bank asked the court for
a decree as to whether Ruby E
Huber is the legal wife of Thorn-
tion and whether the bank is
justified in giving her any of the
funds held for Thornton.
Thornton, an Indian, received
over a million dollar share of
his mother's two million dollar
estate at Gold Beach, Calif.,
when she died. The other half
of the estate went to Thornton's
brother.
He met his present wife in the
Holland hotel about the first of
the year, where she was a cook.
In her complaint she states they
were married March 16, in Stev
enson, Wash. Bengston will de
fend her against the claims of the
Portland Trust bank in Portland
June 11. ,

Shock Stops Heart
For Wall Repairs

geons have successfully stopped
the heart of an 11-year-old girl
with low voltage electric shock
to repair a hole in one of the
organ's inner walls.
The medical mile-stone was
achieved by a surgical team
from the state university's Col
lege of Medicine in a recent op
eration on Michele Lauer, of
Brooklyn, at Kings County hos
pital, it was revealed Friday.
Human hearts have been still
ed for surgery before but the
delicate operation was the first
achieved with the low voltage
electrical shock.
The college said that the op
eration was performed by a
team including Dr. Clarence
Dennis, professor of surgery,
and Dr. Adrian Kantrowitz, as
sistant professor of surgery.
Man Bound Over to
Circuit Court Here
James LaMonte Bradley, 29,
of 6119 Crater Lake highway,
Medford, was bound over to cir
cuit court Saturday morning,
when he appeared for arraign
ment in district court on a grand
larceny charge.
Bradley was released on his
own recognisance until his cir
cuit hearing Tuesday at 8:30
a.m.
He was arrested by sheriff's
deputies in connection with the
theft of lumber that day from
the Ross Lumber company.
Three Believed Victims
Of Columbia High Water
Kennewick, Wash. (U.R)
Three unidentified persons were
feared victims of the high wa
ters of the Columbia river near
here Saturday.
Authorities searched the river,
off old highway 410, for a car
and three persons believed swept
into the river by the current.
Rocky Dorsett, manager of a
driving range near the highway,
told police he saw the back end
of car in the water. He said one
man apparently escaped. 1
Salem School District
Approves 56-57 Budget
Salem U.R) Salem school
district voters Friday approved
a 1956-57 budget by a 444 vote
margin. Final official count was
2,282 to 1,838.
Some $1,629,316 of the school
budget was over the six per cent
legal limitation with the total
budget running to $5,070,899. Of
that amount, taxpayers will pay
$3,360,583.
The vote was expected to add
about 7.1 mills to school district
tax assessments.

Phoenix Miss Sandra Ow
ens was crowned queen of the
Phoenix May festival Saturday
morning and reigned over the
parade through town and day
long activities at the Commun
ity club grounds.
Miss Owens, whose picture
appears in today's Mail Trib
une social section, was crowned
by last year's queen, Miss Shar
on James. Selection was based
on Festival ticket sales.
Festival activities got under
way at 10:30 a.m., with the Cub
and Boy Scouts leading the flag
salute and the Phoenix High
school band playing the Star
Spangled Banner.
Queen Introduced
Following introduction and
coronation of the queen, Curt
Fisher, master of ceremonies, in
troduced Phoenix Mayor Dan
Adams. He introduced visiting
mayors and George Smith, the
queen chairman, introduced
Miss James.
Following the coronation, the
parade left the community
grounds at 11 a.m., under the
leadership of a National Guard
marching unit. A large crowd

Jet Pilot Killed
Overshooting Field
Nellis AFB, Nev. U.R)
The pilot of an F86 jet was
killed 60 miles north of here
Friday night when he overshot
the runaway of a private land
ing field and crashed.
Indentification of the pilot,
stationed here, was withheld
pending notification of next of
kin.
Nellis officers said the pilot
attempted to make a forced
landing at Overton, Nev., when
the plane developed engine trou
ble. The plane burned.
