Wins Temporary
Custody Battle
San Jose U.R) Mrs. Marjo
rie Smith of Portland, Ore., who
was acquitted last April of the
car-bombing murder of her law
yer husband, has won at least a
temporary victory in her fight
to regain the custody of her 3-year-old
dfughter.
The 34year-old mother was
granted temporary custody of
the little girl yesterday by Supe
rior Court Judge J. G. Del Mato
la. The child, Susan, has been
living at the home of her aunt,
Mrs. Ellen Hightower, of Los
Gatos, Calif.
Taken From Home
Mrs. Hightower took Susan
from the Smith home at Port
land last April 25 after Mrs.
Smith was arrested for complic
ity in the murder of her hus
band. Mrs. Smith was subse
quently tried and acquitted of
conspiring with Victor Laurence
Wolfe. 45, to commit the mur
der. Wolfe was convicted of
murder in the second degree.
Mrs. Smith testified yester
day that she saw her daughter
Sunday night for the first time
since last April, but the little
girl did not recognize her.
However, Judge Del Matola
ordered Mrs. Hightower to turn
the child over to her mother "as
noon as it is practical" because
there is "no provision In Cali
fornia law" , for the present ar
rangement. The judge ordered Mrs. Smith
to keep Susan in Santa Clara
county until it is determined
whether she. or Mrs. Hightower
has the legal right to take care
of the child.
Mrs. Hightower's attorneys
said in court yesterday that they
would prove that Mrs. Smitn
was "dissolute and promiscu
ous" and therefore an unfit
guardian for her daughter.

Cause of Train Wreck Investigated

report today on whether a 62-year-old
engineer died of a heart
attack or was killed in the
wreck of a Norfolk and Western
passenger train which injured
30 persons.
Mingo County Coroner Tabor
Ball said officials were explor
ing the possibility that engineer
Walt Willard, of Bluefield.
W. Va., died at the controls of
the train just before the wreck.

The train was not believed to
have been traveling at an ex
cessive speed. The maximum
speed for the curve is 30 miles
per hour, and an unofficial
source said the train did not ap
pear to be exceeding that speed.
It was reported that it was
snowing at the time.
Australia has developed a new
form of butter concentrate that
