Christmas trees was the best in
several years, the State Forestry
Department said today, and it
praised commercial harvesters
for selling) almost all c2 the trees
on the corner tree lots.
"Few trees were wasted;"
Charles H. Ladd, chief farm for

received for well shaped trees.

Chair by Pleading Insanity

seen in an American Court of

off on a plea
that, for a few
hours, he was
Insane. Us
ually, two or
three experts
testify that, at
the time of the
assault, the
man was in
sane and unable to tell right
from wrong; while three other
experts testify that he was sane.
The decision as to which of
the experts was talking most
foolishly is then put up to a
jury of laymen who know ab
solutely nothing about the sub
ject, and who have no ideas as
to what the early or transient
symptoms of insanity are. If
they had to question a man as
to his sanity, they would not
know how to go about it.
What amuses me is that, for
the purposes of a Court, the
man has to be either sane or
insane; he cannot be half-way
between. And yet, all of us men
and women know that there are
a million persons in this coun
try who, while they may never
become queer enough so that
they have to be locked up, are
too queer to live comfortably
with anyone, or to marry any
one, or perhaps even to work
with anyone.
What happens usually at the
murder trial is that if the man
is let off on the plea of tem
porary insanity and is commit
ted to a hospital for the crim
inally insane, within a few
weeks, his lawyers are trying
to get him freed on the plea
that he is sane again. It is far
from a pleasing or edifying
spectacle!
Should Think of Psychosis
What bothers me, also, is that
when a man who, from the story
of his behavior is obviously
psychotic, murders someone he
is likely to be quickly convicted
and sentenced to death. Some
times the question of insanity
is hardly raised. Why? Because,
as the papers say, it was so
atrocious a murder over which
the man showed not the slight
est compunction. Actually, the
fact that a murderer was need
lessly brutal, and later showed
no regret, should make everyone
think of psychosis.
In many of the cases, if the
court were to ask a couple of
psychiatrists what they think
of the man, even without see
ing him, they would say "Don t
bother to try him; he is psy
chotic." Occasionally, I read that
a mother is being tried for the
murder of a child or two. Why
try her? Why waste time and
money? She must have been out
of her mind. Just ask her why
she did it and she may say,
"Because God told me to."
One wonders why our penal
code cannot be amended so that,
if experts on insanity are to be
heard, they will be employed
by the .court and paid by the
court; they will be "friends of
the court," with no interest one
way or the other in what hap
pens to the prisoner. Their only
interest will be to help the judge
and the jury in understanding
the man and why he acted as
he did.
Would Listen io Family
Often, I think that much bet
ter than having experts before
the Court, would be the listen
ing to the members of the pa
tient's family, his neighbors and
friends, and the people with
whom he works if he ever did
work. I know that often, by
talking to such people, in a few
minutes I can learn much more
about a man's sanity than I could
learn by talking to him for two
hours. I remember when one

cisco, a brilliant physician, who
for months was going insane;
it was very hard for me, who
knew him well and worked along
side of him, to be sure of what
was happening. The trouble was
that he had always been so
eccentric. All that his friends
could say was that, about a cer
tain time, he became- a bit more
eccentric and queer and choleric
than he ever had been before.
His behavior became too odd for
him. Often, when discussing the
sanity of a brother or a father
or uncle with his family, they
will say, "But he was always
eccentric and odd." But then a
relative will say, "But no, he
was never that bad before;" and
this is the essential point. He
never was that bad, and only
the family or close friends can
say this.
One great difficulty in the
way of caring for the insane in
courts of law is that the lawyers
stick to an ancient definition
of insanity. I remember a para
noid man who easily went free
after he had murdered his neigh
bor who hadn't done him any
harm. He assumed that the
neighbor had been planning to
make love to his mousy little
wife. The lawyers argued for
days as to whether the man had
the requisite knowledge of right
and wrong; that was all that
bothered them. But the jury let
him off because, as they said,
everyone in town knew he was
crazy! Later he shot another
man who had done him no harm.
Tear Gas Grenade Not
Funny, Police State
Gaston, Ore. (U.R) Police
Chief Robert T. Wiss said today
he didn't think someone's idea
of a Christmas joke was very
funny. Some 200 persons were
chased from a dance here early
Monday when a tear gas grenade
was dropped into a rest room
waste-basket. The chief said he
expected to make an arrest.

Emergency Funds For Flood Victims
Salem (U.R) Grants from fed
eral emergency funds will be
available to flood-stricken cities
and counties of Oregon for
restoration or repair of sewer
and water lines and for repair or
building of county bridges,
Gov. Paul L. Patterson said yes
terday. The governor said he had been
advised that such applications
for grants should not be made
until a complete survey of dam
age has been made.
As a result, he has asked
Arthur M. Sheets, civil defense
.director for Oregon, to arrange
for the appointment of teams to
make the necessary surveys.
As soon as these surveys are
completed, the proper applica
tions will be made to Washing
ton, D.C.
