The above matter having come on
to be heard, upon motion of peti
tioners, appearing by Frank J. Van
Dyke their counsel, for an order set
ting the time and place certain for
the election on the proposed incor
poration of the Elk City Water Dist
rict and making the arrangements

May. 1955. final public hearing was
had. at which time no persons came
forward to enter objections to the pro
posed incorporation and at wmcn time
the court made certain findings ot
fact entered of record herein, and the
court being fully advised in the prem
ises and good cause appearing tnere

Jackson Street in the City of Med
ford. Oregon, and for the assessment
of the cost thereof on adjacent prop

said improvement and providing for
the serving of the owners of adjacent
property with notice thereof by the
Recorder.
THE CITY OF MEDFORD DOTH
ORDAIN AS FOLLOWS:
Section 1. That it is the intention of
the Council to cause to be constructed
paving, concrete curbs and gutters,
driveways on Oak Street from West
Second Street to West Jackson Street
in accordance with the plans and
specifications on file in the office of
the City Manager, at the City Hall,
Medford. Oregon, to which plans and
specifications reference is hereby
made for details and estimated costs
thereof, and to assess upon each lot,
or part thereof, adjacent to and bene
fited by such improvement its propor
tionate share of the cost of said im
provement as provided by the Charter
of the City of Medford.
Section 2. The Council will meet in
the Council Chambers at the City
Hall on the 21st day of June. 1955 at
7:30 P.M.. at which time and place
the owners of said adiacent property
are hereby called upon to appear be
fore said Council and show cause, if
any, why said improvement should
not be constructed, and why said
property should not be assessed for
the construction thereof.
Section 3. That warrants for the
costs of the aforementioned improve
ment shall bear interest at four per
cent (4) per annum and shall con
stitute general obligations of the City
of Medford. and the terms and con
ditions of said warrants shall be as
provided bv in Oregon Revised Stat
utes 287.502 to 287.510 inclusive.
Section 4. The City Recorder is
hereby directed to serve notice hereof
upon the property owners aforesaid,
by publishing this Ordinance once in
a daily newspaper, printed, published,
and of general circulation in said City
at least ten (101 days before the date
of said meeting, and by posting five
copies of this Ordinance in five pub
lic and conspicuous places in said
City for a period of ten (10) . days
prior to said meeting.
