Mystery of Rubinstein Slaying
Continues To Baffle Law Officers
New York OJ.PJ "The mys
tery of the case lies everywhere."
That statement, from the de
tective in charge, is the best
answer available exactly four
months after the slaying to
the tantalizing question: "Who
killed Serge Rubinstein?"
The shadowy millionaire fi
nancial manipulator, draft dodg
er, and pretty-girl fancier is as
much a question mark in death
as he was in life. The hunt for
his slayer has led police through
dark alleys of international fi
nance, into the Manhattan night
club jungle, in and out of prisons.
Around the Clock
"Sin.-e the murder we have
questioned more than 1,000 per
sons," said Edward Feeley, dep
uty chief inspector in charge of
the detective force in the plush
division known as Manhattan
East.
"The men are working around
the clock, still, on the case. We
have tracked down numerous
leads; we follow every hint of a
lead, every anonymous phone
call."
Investigating' the murder now
are an assistant district attorney,
two high police officials, and 15
crack detectives. At one time,
there were 125 men assigned to
the case.
From those close to the investi
gation it was learned lhat almost
every theory evolved from the
exhaustive search has included a
woman as part of the crime, prob
ably one of the many women to
whom Rubinstein gave keys to
the grillwork door of his Fifth
Avenue mansion.
The suave and often ruthless
Serge made many enemies, both
male and female, during his life
of love and finance. Young and
aspiring actresses and models
liked to be seen with him, think
ing it would help them get ahead.
Nothing But Vows
"Rubinstein took advantage of
the situation," one informant
said. "He gave the girls nothing
but vows of love and expensive
evenings, which usually ended
in his home. Sometimes he enter
tained women in groups of two
or three. He gave them keys so
they could enter his mansion
whenever they were summoned."
Rubinstein was strangled in
his ornate bedroom sometime be
tween 1:30 and 8:30 a.m. last
Jan. 27. At this phase of the in
vestigation, it was learned, de
tectives' thinking runs to two
prime possibilities.
1. An ex-convict who heard
about Rubinstein's wealth
through the prison grapevine en
tered the house planning rob
bery, bungled the job, killed
Rubinstein, and fled without any
thing. 2. A person ruined financially
by Rubinstein got a key to the
mansion and had Rubinstein
killed in revenge, staging the
crime to appear as a robbery or
burglary attempt.
Ballot Title for
Fag Tax Vote Drafted
Salem (U.R) A ballot title
has been drafted by attorney gen
eral Robert Y. Thornton for pos
sible referral of the 3 cent a
pack tax on cigarettes voted by
the 1955 ' Legislature and ap
proved by Gov. Paul L. Patter
son. Thornton's action followed a
move by the tobacco industry to
refer the measure. Preliminary
petitions for referral were filed
Thursday by the industry, which
claims it cannot afford to collect
taxes for the state?
The tax would not become ef
fective, in any case, until Aug.
4. If the cigarette industry ob
tains sufficient signatures on pe
titions to refer the proposal, the
tax could not take effect until
after voter approval at the next
November election.
Warning Issued on
Eating of Oregon
Mussels and Clams
Portland (U.R) A warning
against eating marine mussels
or uncleaned clams taken from
Oregon coastal waters this
spring and summer has been
issued by Dr. Harold M. Erick
son, state health officer.
Dr. Erickscn said Oregon
clams are delicious, but it is un
safe to eat any portion of the
mussels or the digestive organs
of clams this time of year be
cause they may contain a strong
alkaloid poison similar to strych
nine. Feeding on Plankton
The poison results from the
mussels or clams feeding on a
microscopic organism called
plankton which is occasionally
washed in by the ocean during
summer months.
"Reputable commercial pack
ers are aware of the danger and
do not permit any of the harm
ful seafood to enter the open
market," Dr. Erickson said. The
sale and distribution of marine
mussels and uncleaned clams is
prohibited by state board of
health regulations between May
1 and October 31.
Remove Black Portions
Individuals digging clams dur
ing the danger period were
urged to remove all black por
tions before eating. White meat
and muscular tissues of the
clams do not contain the poison.
Dr. Erickson emphasized that
the black portions should be de
stroyed completely and should
never be fed to animals or
domestic fowl, which are also
susceptible to the poison.
Longshore Work
Stoppage Due June 6
Portland (U.R) A 24-hour
work stoppage will be staged
June 6 by Pacific Coast long
shoremen in protest against gov
ernment efforts to cancel the
citizenship of Harry Bridges,
president of ' the International
Longshoremn and Warehouse
men's union.
Bridges will stand trial in San
Francisco June 20.
Announcement of the work
stoppage was made in Portland
by Francis J. Murnane of local
No. 8 of the ILWU, who said
the work stoppage will affect
all coast ports.
Simultaneously with the walk
out, a committee from the union
will call on President Eisenhow
er with petitions asking for dis
missal of the action against
Bridges.

An awning at Walt's Radio
and Electric shop, 409 East Main
st., was destroyed by fire about
10:30 p.m. Friday. The fire
started from a cigarette tossed
onto the awning, firemen said.
Salesman Charged
With Hypnotism
In Rape of Gi
Mobile, Ala. (U.R) Police
are holding a 25-year-old sales
man on charges of hypnotizing
his friend's 17-year-old wife, tell
ing her he was her husband and
raping her in what a detective
called the most "fantastic case"
he had ever heard of.
The salesman, Jesse Overton
Jr., married and the father of a
small child, admitted in a writ
ten statement he was intimate
with the young mother while her
husband was at work . last
Wednesday but claimed it was
not the first time she had sub
mitted to him.
Found in Partial Trance
The girl's husband told De
tective Talley Rollins that he
found her in a partial trance,
broke through this "mental
block" by using his own hyp
notic influence and learned from
her the story of the alleged rape.
"It's one for the books," Rol
lins said. ."I've never heard of a
more fantastic ease. But both
the husband and wife are em
phatic about its validity."
Told Same Story
Rollins said the husband, while
giving his account in the detec
tive bureau, hypnotized his wife
on the spot. While she was in the
trance, Rollins said, she gave
the same account her husband
had given but claimed she could
remember nothing about it while
not under a hypnotic influence.
Overton said he himself had
been a hypnotist for 10 years. He
said he often hypnotized his
pregnant wife and that she was
able to hypnotize herself.
"When she's ready to have the
baby, she's going to hypnotize
herself and deliver it without
anesthetics," he said.
Gorilla Snatches
Child From Mother
Brazzaville, France Equatorial
Africa (U.R) A giant gorilla
stole a one-year-old child from
his mother's arms yesterday and
carried him into the jungle
where the mutilated body was
found hours later.
The attack took place on a
trail near the village of Mou
koundou which lies by the
source waters of the Ngounie
River.
The huge beast attacked the
woman, who was walking with
her 7-year-old son and carrying
the younger child. He knocked
her off her feet and then at
tacked the older child.
The mother wrestled with the
beast and managed to free her
older son but the gorilla
knocked her down a second time
and snatched the infant from
her arms.
j Village hunters tracked the
gorilla and found the mutilated
body of the baby, dead of head
injuries.
Jaycee Truck, Tree
Stop at Pendleton
Pendleton U.R) A highly
decorated truck rig carrying a
1000-year-old Douglas fir and
two delegates to the National
Jaycee convention in Atlanta,
Ga., paused at its first itop here
Friday night.
Delegates were Gerry Rucker
of Parkrose, Ore., and Wayne
McCall, Cottage Grove, Ore.
They plan to arrive at Atlanta
after stops at more than 200
towns along the way.
The Oregon delegation to the
national convention of Junior
Chambers of Commerce has
scheduled stops at Chicago,
Minneapolis and New York, and
will be greeted by mayors and
Jaycee dignitaries at each stop.
The log, 6VS feet in diameter
at its base and 24 feet long, was
donated by Georgia-Pacific Ply
wood. The truck was donated by
Mack Trucks. j

Reopen Timberline Lodge
Portland (U.R) A contract
has been signed to pave the way
for reopening of Timberline
Lodge, Mt. Hood restort hotel,
on July 1.
Richard L. Kohnstamm sign
ed papers as new official per

est Service. He said he would let
contracts immediately for repair
work on roofs, plumbling and
other areas of the lodge before
the formal opening.
The lodge was closed several
months ago when a federal tax
lien was placed on equipment
of the former permittee!.

Klamath Falls (U.R) The
city budget committee here has
completed its 1955-56 budget, to
taling more than $940,000.
Included was a $1000 item for
study of upper Klamath lake's
algae problem. Deleted was $7,
200 for a professional city planner.
Salem (U.R) Jackson, Doug
las and Curry counties report
ed payroll increases ranging,
around 82,000,000 each for
1954, according to the State Un
employment Compensation Com
mission. But declines in 22 of the
state's 36 counties brought an
over-all loss of $20,000,000 or
1.6 per cent from the record
$1,298,330,029 covered by the
unemployment law in 1953.

Defaults in Suit
On Timber Sales
Portland (U.R) Fred M.
Marsh, Lebanon timberman who
served a federal prison term 'for
defrauding the U.S. in a series
of Indian trust timberland deals,
has defaulted in a civil action
brought by the government to
void many of the transactions,
according to federal court sour
ces here.
Also issued default orders by
U. S. Judge Gus J. Solomon was
Marsh's wife, Irene, and two In
dians, Mr. and Mrs. Frank Sum
mers. Indians Said 'Used'
The government claims the
Marsh couple used the Summers
to buy Indian timberland in
Douglas and Lane counties for
a third of its actual value.
The action also named as de
fendants Clyde Flinn, The Dal
les, former land officer for the
Indian bureau area office here,
and Francis E. LaGrance, Flinn's
assistant when both worked for
the government.
Flinn served a prison term for
defrauding the government. La
Grance was dismissed from the
Indian bureau after a depart
ment of interior investigation.
Both deny the allegations in the
government's civil suit.
The trial date has not yet been
set.

bor dispute during the summer
months, the woods product in
dustry fell short of previous
high marks. Construction and
food processing were next among
basic industries.
Curry county with increased
construction and plywood mill
operations led all divisions with
a 37.2 per cent increase from
1953 to 1954, reaching a total
of $7,983,882 and passing sev
eral other counties. Sherman
and Morrow had next best per
centages with 21.3 and 10.1 but
Jackson and Douglas did better
in the dollars and - cents col
umns. Multnomah Off .
Multnomah county's payrolls
dropped off .7 per cent to $582,
214,568. Lane in second place
had a more severe decline of
$5,883,934, mainly because of
the labor dispute in mid-summer.
Douglas county increased
its lead for third position with
Coos remaining fourth despite a
drop of $4,199,618 Marion de
creased onlyq $1,166,890 but re
mained slightly behind Coos.

Ex-Oregon Prison
Inmate Takes Life
Of Policeman, Self
Alturas, Calif. (U.R) A
vengeful rapist, convicted in
1948 for the rape of his step
daughter, killed a California
highway patrolman in a furious
gun battle and then ended his
own life.
The rapist, 56-year-old Her
bert Petty, who was paroled
from the Oregon State peniten
tiary last year, blew the top of
his head off with a rifle bullet
after the duel in which James
Marooney, 33, was fatally in
jured. Convicted in McMinnville
Petty was convicted in Mc-
Minnville, Ore., for the rape of
his stepdaughter, now Mrs. Dick
Wade of Alturas.
Mrs. Wade said Petty unex
pectedly entered her cabin 14
miles south of here Friday after
her husband had gone to work.
Mrs. Wade was able to get
away from the cabin to summon
patrol officers when a neighbor
arrived to baby sit for Mrs.
Wade.
Petty bolted from the cabin
when the patrolmen arrived and
began firing at them from heavy
brush country back of the cabin,
Maroney was fatally wounded
by a single shot which went
through a power pole he was
crouched behind. Moments later,
Petty turned the rifle on him
self. '
Portland Market
Robbed of $4,000
Portland (U.R) Zim's Su
permarket was held up here late
Friday night by a trio of armed
bandits who kidnaped a store
clerk and escaped with an esti
mated $4000.
Police were not notified for
15 minutes after the robbers
disappeared with their victim
because another clerk was tied
with electric cording and could
not free himself for a quarter of
an hour.
Ernest Long was forced at
gunpoint to drive two of the rob
bers from the store. A few blocks
away he was pushed to the floor
of the back seat of the. getaway
car and driven around Portland
for some 45 minutes with a gun
held at his temple.
Long told police he was releas
ed near the Portland Yacht club
where his captors transferred
to another car.
He was unable to describe the
bandits to police except to say
they did not appear to be ner
vous and they wore cheap cloth
ing.
The robbery was staged just
as the store was being closed for
the night.
Richmond, Va (U.R) An
drew H. Adams, charged with
driving without a license, told
traffic Judge Carleton E. Jewett
he "just put off" getting one
for 24 years. He was fined $25.
