cost thereof upon each lot or part
thereof adjacent to and benefited by
sucn improvement its proportionate
share of the cost of said improvement,
and did fix the time and place for
hearing protests against the construc

WHEREAS said Ordinance was duly
posted and published-as reauired by
the Charter of the City. And
WHEREAS a meeting of the Council
was held at the time and place fixed
in said Ordingace for the purpose
of considering any such protests, but
no protests were at such time, or at
any time, made to, or received by
the Council to the construction of
said improvement, or the assessing
of the cost thereof, as aforesaid, and
said Council has considered the mat
ter and deeming that said construction
of said improvement was and is i of
material benefit to said City, and that
all the property to be assessed there

the extent of the probable amount of

from Oakdale Avenue to South Holly
Street in the City of Medford. Ore
gon; and -directing the Recorder to
enter a statement thereof in the
Docket of City Liens and publish a
notice thereof as reauired by the
Charter.--
THE CITY OF MEDFORD DOTH
ORDAIN AS FOLLOWS:
Section 1. WHEREAS, .the City
Council did heretofore by Ordinance
declare its intention to construct-concrete
curbs and gutters, driveways and
asphaltic concrete pavement on Mel
rose Avenue from Oakdale Avenue to
South Holly Street in the City of
Medford, Oregon; and to assess the
cost thereof upon each lot or part
thereof adjacent to and benefited by
such - improvement its proportionate
share of the cost of said improve
ment, and did fix the time and place
for hearing protests against the con
struction - of said improvement, and
the assessment of the cost thereof, as
aforesaid. And '
WHEREAS said Ordinance was duly
posted and published as required by
the Charter of the City. And
. WHEREAS a meeting of the Coun
cil was held at the time and place
fixed in said Ordinance for the pur
pose of considering any such protests,
but no protests were at such -time, or
at any time, made to. or received by
the Council to the construction of said
improvement, or the assessing of the
cost thereof, as aforesaid. - and : said
Council has considered the matter
and deeming that said construction, of
said- improvement was and is of
material benefit to said City, and that
