AN ORDINANCE declaring the as
sessment on property benefited for
the cost of constructing concrete curbs
and gutters, driveways and asphaltic
concrete paving on Niantic Street
from Manzaiuta Street to Edwards
Street in the City of Medford. Ore
gon; and directing the Recorder to
enter- a statement thereof in the
Docket of Citv .Liens and publish a
notice thereof as required by the
Charter.
THE CITY OF MEDFORD DOTH
ORDAIN AS FOLLOWS:
Section 1. WHEREAS, the City
Council did heretofore by Ordinance
declare its intention to construct con
crete curbs and gutters, driveways
and asphaltic concrete paving on
Niantic Street from Manzaiuta Street
to Edwards Street, in the City of
Medford.- Oregon; and to assess the
cost thereof upon - each lot or part
thereof adjacent to and benefited by
such, improvement its proportionate
share of the cost of said improve
ment, and did fix the time and place
for hearing protests against the con
struction of said improvement. - and
the assessment of the cost thereof, as
aforesaid. And
' WHEREAS said Ordinance was duly
posted and published as required by
the Charter of the City. And
WHEREAS a meeting of the Council
was held at the tune and place
fixed in said Ordinance for the pur
pose of considering any such pro
tests, but no protests were at such
time, or at any time, made to, or
received by the Council to the con
struction of said improvement, or the
assessing ot tne cost tftereot. as afore
said, and said Council has considered
the matter and deeming that said con
struction of said improvement was
and is of material benefit to said
City, and that all the property to be
assessed therefor will be benefited
thereby to the extent of the probable
amount of the respective assessments
to be levied against said property,
did order . the - construction of . said
improvement. And
WHEREAS, the cost of said improve
ment has been and hereby is deter
mined to Jbe the sum of $12,506.71,
NOW. THEREFORE, it is hereby de
termined that the proportionate share
of tne cost or construction of said
improvement, on each parcel of prop
erty adjacent to said improvement and
benefited thereby is the amount set
opposite the description of each piece
or parcel of land below. - and that
each piece or parcel of land is bene-
med by the construction of said im
provement, to the full extent of the
amount so set opposite such piece or
parcel and that 'the respective amount
represent tne proportional benefits of
said improvement to said respective
parcels of nronertv. and the Council
does hereby declare each of the par
cels of property described below, and
each of the same is hereby assessed
the amount set opposite each respec
tive description, for the cost of the
construction ot said ' improvement. .
