Hawarden, near Sioux City, la.,
and he is self-employed through
the Purucker Piano house as a
piano tuner and repairman. The

Larry and Garry, 10-year-old

Washington school; ; Marvin, , 8,
a third grader there; and Dennis
Ray, 5. Olson's niece and her

James Main, attorney for: the
plaintiff,- C. 'L. Robinson, 'Ross
lane, offered to dismiss the com
plaint, with prejudice, provided
Werhmark's counter -complaint
also "was dismissed." "This, was
done, - and ..the jury was. dis

Based on Agreement
-': The - suit ; was - brought - by
Robinson against . Wernmark
based j on S a verbal . agreement
made in 1951, when Wernmark
had a logging -and clearing con
tract for the area to be; covered
with water behind the Willow
Creek dam, 1 then ' under con
struction. Robinson agreed to do
the logging for Wernmark. He
filed the suit for money he
claimed was due him under the
agreement. - r - -
Wernmark's contention was
that Robinson had been paid in
full, and that he had not com
pleted the work agreed upon.
Conclusion: of 'the case came
after Wernmark's attorney, O.
H. Behgston, moved for a di
rected - verdict favoring Wern;
mark, and Circuit Judg, H. K.
Hanna, who was presiding, over
ruled the motion, although he
said he would consider a sfcnilar
motion after- the defense; case
had been presented.' ,
; - The plaintiffs case was con
cluded, and the defendant's just
begun, when Main made the dis
missal offer.
