key, 42, of 148 Laurel St., Cen
tral Point, has filed a motion
seeking dismissal of the rtate'i
appeal in a check case which
began more than a year ago.
' The appeal to the supreme
court is from a Jackson county
circuit court decision reached
last March 17. Tha decision of
the local court sustained a de-
! fense demurrer, ruling the law
involved in the case is uncon
stitutional. ' MSF Check Charged

Trial in the case was sched
uled to start Oct. 30 of last year,
but after a postponement, Judge
Hanna upheld a demurrer by
Defense Attorney Edward Kelly,
entered on the grounds that the
law involved is unconstitutional.
In upholding the demurrer,
Judge Hanna said the law vio
lated due process and equal pro-
' taction clauses of the constitu
tion, and gave uncontrolled dis
cretion to a grand jury and mag
istrate, with no set standard as
to whether a case under the law
would involve a felony or a
misdemeanor, according to Dis
trict Attorney Walter Nunley.

The state filed notice of ap
peal to Judge Hanna's ruling on
April 15. Due to an error, tran
scripts were not sent to the su
preme court within the 30-day
deadline, end Kelly and Nunley
'.' joined in moving for an exten
sion to the time limit.
The state filed a brief, but
Kelly, in lieu of a brief, this
week submitted- the motion for
'.dismissal. In the motion, Kelly
stated that under Oregon law, a
.certified copy of the notice of
appearand judgment roll were
'not transmitted by the clerk of
;the circuit court, to the supreme
; court, within 30 days after notice
: of appeal. .
