special election for the City of Med
ford on the 19th day of May. 1950,
submitting thereat to the legal voters
of said city proposed acts of municipal
legislation.
THE CITY OF MEDFORD DOTH
ORDAIN AS FOLLOWS:
Section 1. That there be and here
by is called a special election in and
for the city of Medford to be held on
the 19th day of May. 1950 for Ihe pur
pose of submitting thereat to the legal
voters of snid city proposed cts ol
municipal legislation as hereinafter
set forth; said election is hereby or
dered and called to be held between
the hours of 8 o'clock a.m., and 8
o'clock p.m.. on said day at and with
the Oregon state primary election to
be held on said date The provisions
of Ordinance No. 4685 of the City ol
Medford providing for daylight saving
time shall not apply to the election
herein provided for.
Section 2. Said election shall he
held at and with the regular primary
election to be held on the 19th day
of May, 1950 and each precinct with
in the boundaries of the city of Med
ford, as established by the county
court of Jackson County, Oregon as a
voting precinct In said city for gen
eral state elections, is hereby decid
ed to be a voting precinct within the
city of Medford for the special elec
tion hereby called and the polling
places provided for within said re
spective precincts for said primary
election to be held on said day and
the judges and clerks of said election
appointed to conduct such
primary election In said precincts are
hereby designated as the polling
places In snid respective precincts and
the Judges and clerks of election
therein respectively for the special
city election herein provided for.
Section 3. Notice of said special
election shall he given by the Record
er by publication of a full copy of
this ordinance In three issues of the
Medford Mail Tribune, a newhpaper of
general circulation published la the
city of Medford. Oregon, two of
which publications shall he not less
than 10 days prior to snid election,
and by causing a full copy of this or
dinance to he posted at each of the
places for holding said election and
at three public places of the City ol
Medford not less than two weeks
prior to such election.
Section 4, That there he. and here
by is, submitted and proposed to the
legal voters of the city of Medtord
for their approval or rejection at
said special election the following

its powers and defining the duties ol
its officers" and to repeal an act en
titled "An Act to incorporate the
Town of Medford. In Jackson County,
Oregon, approved Februarv 24. 1885"
filed in the office of the Secretary of
State February 21, J88f. and all
amendments thereof, and to Incorpor
ate the City of Mejfurd, in Jackson
County. Oregon, and to define its
powers and duties.'' approved Febru
ary 6. 190); " and to incorporate the
City of Medford. in Jackson County.

BE IT ENACTED RY THE PEOPLK
OF THE CITY OF MEDFORD that the
Charter of the City of Medford. be
ing an act entitled "An Act to repeal

new section to be known as Section
72-X to read as follows, to-wlt;
SECTION 72-X
1. In addition to the bonds hereto
fore authorized the Council of the
City of Medford hereby Is authorized
and empowered to borrow money on
the faith of said City and for that
purpose to issue bonds to obtain funds
to extend and enlarge the municipal
water system, construct additional
pipe lines, reservoirs, dams and other
facilities in connection therewith and
to acquire rights of way, easements
and real and personal property as
shall be necessary or convenient in
connection therewith. The total
amount of indebtedness Incurred and
the bonds issued pursuant to this
Section shall not exceed $2,800,000.00.
2. The debt limitations contained in
the Charter of said City shall not ap
ply to the bonds hereby authorized
or to the indebtedness created by the
issuance of such bonds.
3. Said bonds shall be the General
Obligation of the City of Medford
and shall mature as the council may
determine and the council is hereby
authorized to levy taxes upon the tax
able property within the City of Med
ford in an amount sufficient to pay
the principal and interest on the
bonds hereby authorized.
4. Thr provisions of Sections 177
and 178 of the Charter, shall be
deemed to apply to the bonds hereby
authorized and the payment of the
interest thereon and the revenues ot
the water system of the city of Med
ford shall not be used by the council
for any other purpose than the pay
ment of principal and Interest ol
bonds is&ued lor water purposes.
5. In addition to the powers and
authority heretofore granted to the
Board of Water Commissioners by the
Charter, the Board of Water Commis
sioners is authorized to store and im
pound the waters of Big Butte Creek,
its springs and tributaries, construct
additional pipe lines, reservoirs and
dams lor. and extend and enlarge,
the municipal water system and to
construct and acquire such other la
Cilifies as may be necessary in con
nection therewith and acquire men
land, easements and real and per
sonal property required or convenient
in connection with such purposes; to
apply for. purchase., contract lor or
otherwise acquire the right to store
and impound the waters of Big Butte
Creek, its tributaries and springs for
municipal, domestic, irrigation and in
dustrial use within and without the
boundaries of the city of Medford
and to sell and permit the use of
waters of the city of Medford now or
hereafter acquired without the boun
daries of said city for such purposes
by persons, firms, municipalities, pub
lic and private corporations.
Section 5. The ballot title for the
measure provided to be submitted to
the legal voters by said Ordinance No.
4713. as aforesaid, and returned to
the Recorder by the City Attorney is
adopted as Is hereinafter set forth and
the following are the numbers, ballot
title, and form in which the foregoing
measure will appear upon the ballot;
