Earl Edison Given
12-Year Sentence
To Penifentiary
Circuit Judge H. K. Hanna,
in a sternly worded pronounce
ment, yesterday sentenced Earl
Gorman Edison to 12 years in
the state penitentiary on a
charge of statutory rape. Coun
sel for the defense immediately
announced their Intention to
move for a new trial and Judge
Hanna granted them 30 days in
which to file their motion.
Attorney Edward Branchficld,
who has been associated with
George Roberts in Edison's de
fense, appealed to the court for
leniency before sentence was
pronounced. He declared that
since the jury's guilty verdict
was not unanimous and that
since their deliberations took so
long (seven hours), there were
sufficient grounds for a light
sentence. District Attorney
George Neilson, in an answering
statement, said that, in view of
the serious nature of the crime,
he could see no reason for
leniency.
Pronounces Sentence
In pronouncing sentence,
Judge Hanna pointed out that
he had no choice but to accept
the findings of the jury, who
were the sole judges of fact in
the case. Also, he said, he had
no recourse but to accept the tes
timony of the girl involved as
the true version of the case, to
the exclusion of the attempted
proof of an alibi by the defense.
The defendant. Judge Hanna
continued, had, according to the
jury's findings, committed a
crime that would bring misery
and despair into the life of a
I small girl as long as she lives.
mere was no Dasis lor leniency,
he declared.
When permitted to make a
statement. Edison said, "I just
want to say that I am not guilty
it would be impossible and
we will still prove it." He was
returned to his cell in the county
jail.
