The National Labor Relations
board tonight subpoenaed Paul
R. Porter, ot the War Produc
tion board, and Daniel 8. Ring,
of the maritime eoirtmlnlon, to
appear Monday for questioning
tn connection with a charge that
two of the three NLRB mem
bers are prejudiced against the
Henry J. Kaiser shipbuilding
Interests.
At the same time, the NLRB
gave the Kaiser Interests until
December 30 to substantiate
their claims. Complete affidav
it! had been due today.
The Oregon Shipbuilding Corp.
and the Kaiser Co., Inc., filed
a motion on December T to dis
qualify the board from acting
on C. I. O. charges that three
Kaiser shipyards had signed 11'
legal closed-shop contracts with
A. F. L. unions. They claimed
that Chairman H. A. Millis and
member Regard Rellly had al
ready decided the Kaiser firms
were guilty of violating the na
tional labor relations act, and
maintained the case should be
settled by the War Labor board.
The NLRB asked the Kaiser
firms to support their assertions
and to obtain statements from
Porter, Ring and other men who
were present at a meeting where
allegedly prejudicial statements
were mads.

of solving the nation's critical
manpower problems will never
work, said tonight he will press
for early enactment of a na
tional service act to permit
drafting of men and women for
war work.
Austin who introduced a
"work or fight" bill during the
last session ot congress, predict
ed that the campaign for a na
tional service law will touch off
one of the most heated contro
versies to come up during the
new congress. Such legislation,
he said. Is bitterly opposed by
some members of congress who
look upon it as authorizing "in
voluntary servitude."
Decla-lng flatly that "while
we in America have performed
many miracles since the begin
ning of the war, voluntary meth
ods ot solving the manpower
problems hsve not and can not
work," Austin said in an Inter
view that a "waste ot manpow
er" already is prevalent in many
war industries, including ship
building. The proposed legislation draft
ed by Clark and submitted to
the war manpower commission
declares that "an obligation
rests upon every person to ren
der such personal service in sld
of the wsr effort ss he or the
msy be deemed best fitted to
perform." It provides for regis
tratlon of men from 18 to 8S
years, and ot women from 18 to
SO years of sge.
The President would be auth
oriud to assign persons to any
war work, "including the pro
ductlon ot war .materials of
every sort, transportation and
agriculture, and training for the
performance of all rucn work.'

any Hollywood actors or

The dark-haired bride, whose
age was listed si 23, is the
daughter of Mrs. John Dufferin
Rutherford, a former film
actress.
The pair will spend their
honeymoon In Phoenix, Ariz.

on a combined business and
pleasure trip.
Miss Rutherford was born In
Toronto, Canada, and moved to
Hollywood at the age ot 11. Her
father was well known in the

She first entered radio work but
later was given her chance on

Polly Benedict in the "Andy

William Besch, both about 40,
were found today in their smash
ed automobile 80 feet below the
rim ot an embankment skirting
a rutted logging road IS miles
north of her.
Police said the ear was climb
ing steep hill and apparently
was pitched over the embank
ment when it struck, deep ruts
lit the road.
The sccident oceured Iste last
night as the couple drove back
toward their home at the saw
mill camp, their car laden with

was reported booming tonight
for the first time since the army
gave the annual gridiron classic
the green light last month.
A cspaclty throng of 93,000
was forecast by William C. Ack
erman, graduate mansger of
UCLA, and Earl Mann, in charge
of Georgia ticket sales, because
of the hesvler demsnd.
Mann reported all of Geor
gia's allotted 4,000 tickets hsd
been told and Ackerman said
UCLA's supply was dwindling
He Indicated that he expected a
sell-out by the closing time Mon
day.
UCLA will keep Its ticket of
fices open Sunday.
Both Georgia and UCLA plac

today at his home. He was 70.
One ot California's greatest
all-time athletes and most ea
thuslastlc alumni, Morse organ
lzed the famous University Glee
Club and was author ot the
hymn. "Hall to California." As
university athletic historian he
knews thousands ot university
students and alumni personally.
morse was born in Berkeley
n 1872 and lived in the college
city all his life. He graduated
from California in 1896, one of
six athletes in his Alma Mater's
history to win the "Big C" in
three sports football, baseball
and track.
"Brick" played halfback In
California's first "big gsme"
with Stanford in the spring of
ibm. wniie handing up records
In other sports, however, he
never was able to make his mark
In track until he invented the
"polk vault for distance" to tit
his own special talents.
California athletes throughout
the years have stesdfastly re
fused to attempt to better that
one record "Brick" worked so
hard to establish, snd he still it

all-time "polo vault for distance"
record.
Morse published two books on
the history of California foot
ball, and tor years wrote sports

papers. He was director of the glee
