Back On Job County Clerk
George R. Carter returned to
his desk today after a long
absence because of a major
operation. He said he is feeling
the best in years. The operation

hospital some weeks ago and

recuperating in Portland and at

San Francisco, Nov. 10 (IP)
Doubt that the railroad brother
hoods would go through with
their threat to call a nationwide
strike Dec. 5 was expressed to
day by Dean Wayne Morse who
headed President Roosevelt's
emergency board In railroad ar
bitration. "I do not expect a railroad
strike," Dean Morse declared,
adding that he spoke "entirely
unofficially but as an interested
party and as a friend of labor."
"I am confident that the lead
ers of railroad labor are too
loyal to the trust they owe their
men, and too familiar with the
facts developed before the presi
dent's emergency board to make
the grievous mistake of leading
their men into an unjustifiable
strike, such as a railroad strike
would be at this time," he said.
Morse is dean of the law
school of University of Oregon,
and arbitrator for west coast
waterfront labor disputes. His
expressions were in the form of
a prepared statement, issued on
his return from the east.
His committee agreed to boost
railroad wages on a scale vary
ing from 7li to 13V4 per cent,
but the brotherhoods, demand
ing a 30 per cent increase, re
jected the offer. Railroads
agreed to the boards' proposal.

The supreme court upheld today
sales and use taxes Imposed by
state on national defense con
tracts executed on cost-plus-fixed-fee
basis.
Chief Justice Stone delivered
the decisions, applying specifi
cally to assessments by Alabama
on contractors engaged In con
struction work for the federal
government at Fort McClellan.
No dissent was announced. Jus
tice Jackson did not participate.
The justice department esti
mated that such taxes, if sus
tained, might cost the govern
ment as much as $100,000,000
a year throughout the United
States and would amount to
$28,000,000 on contracts already
let.
Alabama officials contended
the construction was done by
Independent contractors who
were not agents or Instrumen
talities of the United States. The
Alabama supreme court set
aside the taxes.
Alabama sought to collect
$1,372 for sales taxes on lumber
sold by King tt Boozer of Annis
ton to Dunn Construction Co.,
Inc., and John S. Hodgson and
company, Birmingham contract
ors operating under an agree
ment with the government.
A $51 use tax was assessed on
purchases of rooting material
made outside the state by Dunn
and Hodgson.
Each tax was two per cent of
the sale prices.

ty talks secession from Oregon
to aid its mineral development,
one of Its major mining sections
wants to join Josephine county.
L. A. (Slim) Damon of Martal
said so in a letter today, charg
ing that most of the county of
ficials and business men of Cur
ry county "are and have been
hostile to the mining industry.'
Harking back to the time a few
years ago when the Curry coun
ty court brought suit against up
river gold miners and eventual
ly secured restrictive legislation,
Damon offered to "even change
the Rogue River to that It will
go to the tea by way of the
Umpqua."
Damon said three townships
would like to secede and Join
Josephine county.
He did not say how many
people (if any) lived in them.

alongside a blacktop road two
miles southeast of this south
western Indiana village.
