Struck by an automobile

way, Franklin ntzpatrick, 14,
yesterday afternoon suffered a
fractured left hip and a broken
left leg between the knee and
ankle.
The boy's attending physician
said today he was resting fairly
comfortably in Sacred Heart
hospital. The doctor said his
condition was serious, because
of the severe fractures, but
probably not critical.
The car, according to state
police, was operated by Vernon
Turpin of Phoenix, who was
accompanied by Jack R. Nail of
1007 Reddy avenue. The driver
was not held, as the accident
was said to have been unavoid
able, according to state police.
Police said they learned that
Tranklin. walking along the
road with his aunt, Mrs. Mary
Berkheimer of route 3, sud
denly darted directly into the
path of the Turpin car, a 1940
P o n t i a c coupe, as It drew
abreast of the two pedestrians.
Franklin and his aunt were
walking west on the right side
of the road, the same direction
being traveled by the automo
bile. Turpin told police that he
lowed down and swung wide
to the left as he started to pass
the boy and his aunt, and that
young Fitzpatrick, for no ap
parent reason, ran in front of
the car.
Franklin was struck by the
right front fender and bumper
of the behlcle and tossed, ac
cording to his aunt, several feet
Into the air. The point of the
accident was about 100 yards
from the Mr. and Mrs. W. J.
Berkheimer home, where Frank
lin was residing.
Perl's ambulance was sum
moned and removed the Injured
youth to the hospital.

Enrollment of youths In the
civilian conservation corps for
the current period ended to
day, with Jackson county fall
ing far short of its quota.
Three Jackson county boys
were formally enrolled yester
day, bringing the county's total
to six. Original quota for the
county was 34 but subsequently
the quota was lifted and the
CCC authorized to enroll any
available number from this sec
tion. Eight were enrolled from
Josephine county.
All of the new enrollees were
assigned to Camp South Ump
qua Falls.

before a justice court Jury to
day. The case was expected
to go to the Jury this afternoon.
The complaint was signed by
Mrs. Rita Muzzl of Santa Clara,
Cel., whose sister-in-law, Cath
erine Muzzl, of Santa Clara.

Mr. and Mrs. Oliver Hilkey of
Butte Falls.
Robert Edward Schnurr was
born on August 28 at Butte
Falls. He was a sophomore at
the Butte Falls high school. He
Is survived by his mother, Mrs.
May Cook, his step-father, Ed
ward Cook, his brother, Roy,
and a sister, June.
Funeral services will be held
in the Perl. chapel at 1:30 p.m.
Friday, Dr. Sherman L. Divine,
pastor of the First Presbyterian
church officiating. Six fellow
students of the Butte Falls high
school will be pallbearers. Bur
ial will take place in the Butte
Falls cemetery.

The difficulty of keeping to
an agreed price was indicated in
the July 27 issue of the Pacific
Rural Press. 'This canning pear
deal gives one heart failure to
follow," the article began. Then
followed a variety of quoted
prices for cannery Bartletts In
a number of northern California
centers.
"Canners paid $32.50 a ton on
the Sacramento river for can
nery grades (which exceed pro
rate grades) for 2i Inches and
then for pro-rate grades and 2'
inch size," the article said.
"Some growers sold S'4 Inch
seconds for $17.50. Packing
house culls, coming off the "left
hand side of the grader,' sold by
the lot for $17.50, asked $32.90
per ton.
"The going price thereafter
was $30 for pro-rate grade 2H
inches in the Santa Clara valley.
Growers there who had voted
to ask $43 and then reconsidered
to ask $40 were out threatening
neighbors who sold for Sao.
Many of the growers in tliia val
ley were picking and delivering
to canners of their choice before
a price was agreed to, with a
2?s inch size basis."
Prices in other districts were
quoted, showing a variation be
tween $30 and $27.50. "Two out

teachers certificate was rejected
by the state board of education
at its meeting here last night.
The board held that Jewett had
failed to comply with the re
quirement tnat he show a past

discharged from the Eureka
school district In 1937 on
