JELLS HER STORY
IN BUSBH TRIAL
Medford Doctor Tells Of
Examining Girl Shortly
After Cave City Capture.
Merced, Cal., Dec. 7. OP)
Dorothy Thompson, 14, testified
today that protestations of love,
promises of an education and
finally fear of the police caused
her to leave her Livingston,
Cal., home and go with Merrill
Busby to San Francisco and
finally to Oregon.
The girl told the story as the
first prosecution witness against
Busby on charges of child steal
ing, abduction and conspiracy.
Busby's sister, Sally Stanford,
and Dorothy Heber, both of San
Francisco, have been similarly
charged but will be tried sep
arately. Answering questions put by
Leo R. Friedman, defense at
torney, the girl said she stayed
with the 28-year old Busby in
several San Francisco hotels but
always resisted his advances.
Attack Claimed
She asserted, however, she
was attacked near Cave Junc
tion, Ore., after they had fled
from San Francisco to elude
police.
The girl testified Busby told
her the police were looking for
her and said she would be put
in a detention home if caught.
It was then, she said, that they
made arrangements to go on to
Oregon in a borrowed automo
bile. The girl asserted she was
criminally assaulted while they
were in hiding near Cave Junc
tion, and again shortly before
they were taken into custody
in that vicinity.
Dr. W. G. Bishop, of Med
ford, Ore., who examined the
girl shortly after the capture,
testified yesterday for the prose
cution that he could not deter
mine definitely from physical
evidence whether she had sex
ual experience. He said it ap
peared "possible and even prob
able." Snite Holding Own.
Portland, Dec. 7. (IP) Fred
Snite, Chicago businessman and
father of Fred Snite, Jr., in
fantile paralysis victim, who has
traveled from China to France
in an "iron lung," said here
yesterday his son "was holding
his own, that's about all."
Navy System Archaic.
Washington, Dec. 7. (P)
Rep. Maas (R.-Minn.), criticizing
the navy department's system
of bureaus as "archaic," said
today he would press for its
reorganization at the coming
session of congress.

"Llano Kid"
Tito Guizar, the handsome
young Mexican singing star, has
a role right out of O. Henry
in his new picture, "The Llano
Kid," which heads the double
barreled bill of action hits com
ing to the New Rialto theater
for tomorrow and Saturday
only. Starred for the first
time, Guizar plays a western
outlaw who attempts to imper
sonate the long-lost son and
heir of a wealthy ranching fam
ily. He's assisted in the pic
ture anil in the conspiracy
by Gale Sandergaard and Alan
Mowbray. June Clayton has
the romantic lead opposite the
guitar-playing Mexican.

In Frank Capra Hit
There has arisen a Capra tra
dition, a conviction of a certain
special and pervading magic
a magic thrice acclaimed by the
Academy of Motion Picture Arts
and Sciences and long counted
first by countless movie-goers
throughout the world. That
same magic was never in such
full flower as in Frank Cnpra's
latest production to reach the
screen, "Mr. Smith Goes lo
Washington," which opened yes
terday at the Craterian theater
to a capacity crowd.
This essentially plain, power
ful presentation of an implicit
ly American story about a boy
who got into congress en a pass,
and stayed in to whip the gas
house gang under their own
rules, is by any and all meas
ures Frank Capra's greatest
picture.
Mr. Capra's hero is a young
man appointed to the senate by
a controlled governor to serve
the unexpired term of an ex
pired junior senator, and take
orders from the venal senior
senator, who takes his from a
plundering publisher.
: Enamored of the Lincoln pre
cedent, the youngster stumbles
upon the truth about his ap
pointment and is ridden down
by the machine when he at
tempts to expose the steal. Fac
ing expulsion, he filibusters single-handedly
to such persistent
length that his naively earnest
eloquence breaks down the pow
ers arrayed against him. Sim
ple as it sounds in synopsis,
the story is, as told, as deep
and sound and powerful as any
the screen has ever offered. .
Next to Capra, to whom top
credit for all Capra pictures
unquestionably belongs, the up
right and oncoming James Stew
art rates lasting acclaim for a
performance good enough to
cinch the Academy award in
any year. Close up on his lead
is Jean Arthur, bettering any
thing she's done previously, and
