Four Residents of Dump
District Complain City
Studying Solution, Word.
Garbage dump question was
again brought to the attention
of the city council at its semi
monthly meeting In city hall
last night, this time by K. V.
Marney, who resides in the vi
cinity of the dump.
Mr. Marney, acting as spokes
man for a group of four resi
dents of the district, asked the
council to do what it could to
eliminate or remove the dump
from its present location. He
stated residents of the vicinity
would appreciate anything the
city could work out In regards
to the removal.

"very conscious of the problem"
and that attempts were being
made to find a solution.
Object To Odor
It is the contention of per
sons living in the neighborhood
of the dump, which is located
just off the Pacific highway op
posite the Bear Creek orchards
packing plant, that the odor
from the dump is very strong,
especially on windy days. The
question of what to do about
the dump has been discussed at
several council meetings, though
to date, no definite plan has
been worked out.
The finance committee rec
ommended the installation of
a six-inch water main on Berke
ley Way, from East Main street
to Woodlawn Drive. A petition
for this installation was signed
by four of the six residents on
the fronting.
A petition signed by 11 resi
dents of the vicinity was sub
mitted to the council, asking
that the city Install and main
tain a street light at the Dakota
and Beckman street Intersec
tion. The petition was referred
to the building and light com
mittee for study.
29 City Court Cases
A report from City Judge
Allen D. Curry for the month
of November disclosed that 29
cases came before the court, re
sulting In a total of $107 in
fines. Included on the docket
were 21 charges of being drunk
In a public place, two viblations
of the basic rule and two reck
less driving.
In a report from Fire Chief
Roy Elliott regarding fire haz
ards removed in the past two
months without ordinance, the
following were named: a plan
ing mill at South First and 11th
streets, a building in the alley
behind Brown's billiards, a
building on South Fir street
between Eighth and Ninth
streets, a two-story barn in the
rear of 600 West 10th street,
and a barn and chicken house
on city property on West Holly
street, between Summit and Co
lumbus avenues. A barn and
house at 12th and Frannucttc
street will be repaired or re
placed, the report said. '

In November showed labor on
alleys between. Ivy and Holly
streets and between Riverside
avenue and Apple street, that
11 bad garbage conditions had
been cleaned up, that 26 boys
under the N.Y.A. were working
in the parks and parking areas
and that all traffic buttons and
pavement markers and red curb

ed. Also, that traffic signs t

Riverside avenue were recondi
tioned. The report further stated that
three driveways on the east side
of South King street were exca
vated, the Intersection of Haven
and Holly streets was resur
faced with buckshot, as was
that at 10th and Elm streets,
and that the concrete culvert
across Jackson boulevard at
McAndrews road was extended.
The base was reconditioned and
all cracks filled on Sixth street
between Riverside avenue and
Front street, and on Eighth
street between Riverside and
Front, the report stated.
It was also brought out in the
report that a crew of five men
were laying rock for revetment
of Crooked creek where the
stream enters Bear creek, and
that six sidewalks and drive- j
ways have been repaired In the
past two weeks.
Sales Authorised
The council authorized the
sale of the following city pro
perty: lot on Narrcgan street to
H. A. Martin and lot on West
Clark street to Goetz Lumber
company.
Seventeen local establish
ments applied for beverage
licenses and all were endorsed
by the council. The applications
were renewals.
In addition to Mayor Furnas,
Councilmcn Larry Schade and
George T. Frcy were absent.
DAVIS SPEAKS AT
Russell D. Davis of the Mcd
ford office of Oregon State Em
ployment service was guest
speaker last evening at the regu
lar meeting of the Active club
held in the Hotel Mcdford.
Mr. Davis gave members a
brief resume of the workings
of the local employment service
in relation to the state unem
ployment compensation commis
sion and the United States em
ployment service. He also
pointed out the manner in which
the compensation commission
issues checks to employees of
industries during slack periods
of work and explained other
phases of the administration of
the service.
The address was well re
ceived and a source of much
information to members present.

IN OAHACK DEATH

A coroner's jury last night
returned findings that no one
was criminally guilty of the
death of Zera Dahack, 71-year-old
Lake Creek rancher who
was killed in a gun battle with
two state policemen Monday
noon on the Dead Indian Soda
Springs road about 10 miles
above the Lake Creek store.
The Inquest, held in the coun
ty courthouse auditorium, was
attended by several hundred
persons, many of them from
Eagle Point, Brownsboro and
the Lake Creek area. Members
of the Jury were E. H. Sleight
H. N. Butler, K. N. Anthony,
D. M. Irving, R. C. Burgess and
H. F. Piatt.
The Jury also found that Da
hack met death by gunshot
wounds and hemorrhage.
Single Wound.
Dr. William P. Holt, who ex
amined the body after it was
brought to Medford, testified
that probing revealed a con
tinuous wound extending from
the right side of the neck, an
Inch and a half above the right
collarbone, to a point between
the right shoulder-blade and
spine at the level of the fifth
rib. Dr. Holt stated that, in
his opinion, the bullet entered
the body at the fifth rib and
came out the neck.
District Attorney Frank J.
Newman conducted the lnqucsr.
He called for testimony, in ad
dition to Dr Holt, Irvin Da
hack, brother of the deceased:
Sgt. Ed Walker and Private
George Albright of the state
police, who were involved in
the shooting; Sgt. O. A. Mac
Kinnon and Capt. Lee M. Bown
of the state police and Justice
of the Peace William R. Cole
man. Exhibits introduced by the
state included the Dahack .38-53
Marlin rifle, an exploded 30-30
shell which Dahack fired at the
state officers, photographs taken
at the scene by Sgt. MacKin

Officer: Give Background.
Officers Walker and Albright
told of the events leading up
to and of the actual shooting,
testifying that Dahack com
manded them to stop their car,
at the point of the rifle, after
they had confiscated 187 pounds
of venison from the Dahack
cabin. They stated that Dahack
fired his rifle as Sgt. Ed Wal
ker climbed out of the car, and
described the resultant exchange
of hots.
The officers testified that Sgt.
Walker fired three times. Pri
vate Albright six timps and
Dahack thrice. It was brought
out by the officers Involved,
and by Sgt. MacKinnon and
Irvin Dahack. that blood whs
found on the ground about 20
feet from the tree and embank
ment where the rjolicemen fired
at Dahack the last time, and
that blood increased In quantity
from there to the point where
the body was found. 237 feet
from the automobile.
Irvin Dahack stated that he
believed his brother saw the
officers leave the cabin with
the deer meat, obtained the
.30-30 shells from the cabin
and raced down the mnimtnin.

ALLEGED FORGER
HELD JBY POLICE
Donald J. Spencer, 30, of 310
North Bartlctt street, was being
held by city police today on a
charge of forgery, following his
arrest yesterday after he alleg
edly passed a $10 check on Gro
ceteria 1. He will probably ap
pear in justice of the peace
court tomorrow, police said.
Spencer, according to the po
lice, forged the name of his
mother, Mrs. Gertrude Spencer,
to the check. When taken into
custody he had over ?8 in his
possession, police said
