'dismissed five counts in the 10
point indictment against Fritz
Kuhn, German-American bund
leader, on trial for grand larceny
in the alleged theft of bund
funds.
The dismissal left Kuhn
charged with the misappropria
tion of only $1,217 instead of the
$3,641 originally alleged.
Judge Wallace made his rul
ing after hearing legal argument
in the absence of the Jury.
Contradicted by Lady
Earlier, blonde Mrs. Florence
Camp, once described as "my
golden angel" by Kuhn, appear
ed as a rebuttal witness and con
tradicted testimony given by the
bund leader in his defense.
Both sides rested shortly after
she left the stand.
At the conclusion of the intro
duction of testimony Judge
James G. Wallace announced he
would hear motions this after
noon and summations on Mon
day. This would put the case in
the hands of the jury either late
Monday or Tuesday morning.
The jury was dismissed until
Monday.
Mrs. Camp testified Kuhn
urged her to divorce her hus-
I band, Charles, and to bring her
furniture to New York so they
could use it after their marriage.
Kuhn already was married and
the father of two children.
Missive Not Funny
Handed a copy of Kuhn's
initial love note, in which the
bund leader vowed he was
"terrible" in love with her, Mrs.
Camp said she saw "no fun" in
the missive. Kuhn had testified
he wrote the billet doux "all in
fun" on the night of a ship's
party, aboard the S. S. Western
land. She contradicted Kuhn's test
imony she had given the bund
official $565.76 in cash in re
turn for Kuhn's financing the
transportation of her furniture
from Los Angeles to New York.
Later, under questioning by
the court, however, Mrs. Camp
acknowledged she had given
Kuhn $600 in three installments.
Kuhn had thus accounted for
part of the money which he is
accused of stealing from the
funds of his organization.
The "golden angei" witness,
smartly dressed in a black en
semble with a bustle-backed
dress, testified Kuhn gave her
a ring in August, 1938. She iden
tified the diamond, which Kuhn
had testified was not the one
he had bought.
Never Aided Bund
Mrs. Camp, whom Kuhn had
described as a "patriotic lady"
interested in supporting the
bund, said she had never con
tributed to the bund, had never
become a member of the wo
men's auxiliary and had never
even sympathized with it.
"I knew nothing about the
bund," she said.
Mrs. Camp was dismissed af
ter only 45 minutes on the stand
without more than skirting
the romance that first inspired
the bundesfuehrer to call her
his "heaven-sent" and then fiz
zled out with Kuhn's conclusion
that she was "no lady."
Kuhn looked relieved as she
left the stand, brightening for
the first time since the prose
cution aired his series of lyric
but ungrammatic notes to Mrs.
Camp.

HOPE REVIVES FOR
PEACE ON DOCKS

A resumption of negotiations
between union ship clerks and
waterfiont employers revived
hopes for a settlement of the
current dock tie-up today, as
chamber of commerce execu
tives from communities north of
Bakersfield prepared for an af
ternoon session to discuss the
controversy.
The CIO clerks' seven-man
negotiating committee presented
to the employers written modi
fications on the problem of pref
erential employment for clerks
hired by the month. The ships
clerks association said the em
ployers previously rejected a
proposed compromise.

stock market ran into a tax scare
today, after an early futile at
tempt at a rally, and a handful
of leaders tumbled 1 to 4 points
at the worst.
The list had been following a
do-nothing policy, with prices
moderately mixed, when board
rooms learned the president, at
a Warm Springs press confer
ence, had indicated some consid
eration was being given the mat
ter of taxes to raise about $500,-
000. 000 for hoisting next year's
defense program.
Transfers were in the neigh
borhood of 900,000 shares.
