fell generally over the Rogue River

precipitation was not heavy enough

Carter, 31, of Hood River received a
suspended sentence for six months.

theft. He waived preliminary hear

and pleaded guilty. He whs arrested

fornia after abandoning at the state

suspending sentence the court took

Divorce Granted Alpha Edith
Hart of Ashland was yesterday grant
ed a divorce in circuit court from
John H. Hart, sometimes known as
John H. Keese. Hart was given six
months' suspended sentence In cir
cuit court Monday on a charge of
forging a certificate of title to an
automobile. The felony was made a
basis for ths divorce suit. The di
vorce decree aIo granted the plain
tiff the right to use her former name.

Unlike his earlier plea for peace
which went to Czechoslovakia. Great
Britain and Prance as well as Ger
many, the president directed last
night's message to Hitler only.
"Present negotlstions still atand
open," he said. "They can be con
tinued If you will giro the word."
U. S. Not To Attend
He made It clear at the same time,
however, the United States would
neither sponsor nor attend such a
meeting and that it was for Europe
to work out Its own solution un
aided. He had made hla pleas for peace,
he said, because:
"The conscience and the Impelling
desire of the people of my country
demand that the voice of their gov
ernment be raised asaln and yet
again to avert and to avoid war."
The decision to send the second
appeal waa reached at a cabinet
meeting yesterday afternoon.
In his message, the president noted
Hitler's historical review of errora
contributing to the present threat
ened war, but said the chief question
now waa "the fate of the world today
and tomorrow.
"The world asks of us who at this
moment are heeds of net Ions the
supreme capacity to achieve the des
tinies of nations without forcing
upon them as a price, the mutilation

restrain state and county agricultural
officials from cutting out the re
mainder of his Central Point pear
orchard, District Attorney Prank J.
Newman stated in circuit court this
morning as counsel argued on an In
terlocutory order to be Issued by
Judge H. D. Norton. Psrt of the
orchard has already been cut out on I
the ground It was Infested with
blight.
Counsel for Mr. Taylor ware try
ing to lay a foundation for "an action
to follow." In contending the court
should Include findings of fact In
hla proposed Interlocutory order, Mr.
Newman asserted.
If a damage suit should be brought.
the court should not permit any of
the evidence or findings of fact of
the present case to be entered before
a Jury In a new case, Gua Newbury
of counsel for Mr. Taylor declared.
Mr. Newbury asserted that the only
Issue before the court In the In
junction proceedings was whether the
defendants were Justified In cutting
down the plaintiff's orchard. About
six acres of the orchard had been
cut out before a temporary restrain
ing order waa Issued by the court
and the present proceedings seeking
permsncnt Injunction were Insti
tuted.
The hearing this morning was on
suggestive decrees, written by coun
sel of both sides for the guidance
of the court In framing the Inter
locutory order. Since counsel could
not agree on the suggestive decrees,
Judge Norton said he would write
the interlocutory order himself. He
stated that ..e would not Include

Under the interlocutory order Mr.
Taylor Is to be given time to clean
blipht from the remaining two and
a half acres of his orchard. The
court Indicated he would give Mr.
Taylor until February 1 to cJean out
the blight. Further hearings would
then be held, it was 'indicated.
The permanent restraining order
Is sought against various state and
county agricultural officials. Through
his counsel. Newbury & Newbury,
Mr, Taylor contends the officials had
a right to enter his -property to re
move blight but had no legal author
ity or constitutional right to cut
out the orchard.
The defendants are represented by
Mr. Newman nnd H. Lawrenco Lister,
an assistant attorney-general from
Salem. Mr. Lister waa not present
at this morning's hearing.
