HEARING ON PEHL
Jury Will Be Drawn From
Regular List Proceed
ings Expected to Last 3
Days Many Witnesses

In the Insanity proceeding! filed
aganst Bui H. Fehl, former county
Judge of Jackson county, will Mart
tomorrow In circuit court here. Judge
H. D. Norton presiding. The hearing
la expected to last three days.
A Jury will be drawn from the
regular Jury llt. The court eald
tha functions of the Jury presented
a legal point that had never been
decided by Oregon courti. revolving
on the question of whether Insanity
proceeding are a cltll action at law
or.sn Insanity case. If they are an
action at law. the Jury function! as
In any civil ault. If an equity case
a lury 1 not required. The court
said the Jury would be called a
safeguard.
The court said the only Oregon
action bearing on the Pehl proceed
ings appears In the 74th Oregon, In
an opinion by Justice Burnett. No
ruling waa rendered on the moot
question however.
The Fehl case waa certified to the
circuit court when County Judge
Earl B. Day disqualified himself, and
tha case waa automatically transfer
reel to the circuit court under Ore
gon law. The circuit court Judge
acta as the county Judge In Insanity
proceedings.
Subpoensa have been Issued for
the presence aa witnesses of the dep
uty warden, chaplain and three state
prison guards. Other witnesses In
clude three Portland alienists. It
waa Indicated consldersble documen
tary evidence. Including writings of
Pehl. would be Introduced.
The Insanity complaint was signed
by Fred Kelly. Mcdford. who will be
represented by his brother. Attorney
K B. Kelly. Fehl will be represented
by Attorney Porter J. Neff, acting at
request of the court.
Pehl was examined November 20
by Dr. D. C. Burks, Dr. H. H. Dlion
and Dr. C. O. Sttrdevant, alienists,
all of Portland, appointed by the
'court In a filed physicians' certifi
cate, and report the three alienists
allege Fehl Is an Insane person, suf
fering from paranoia, and In need of
Institutional care for hla own pro
tection and the protection of others.

bags because of the air stream In
duced through the funnels by their
turning.
Besides being effortless. Chamber
lain says the method la much more
successful thsn of old because the
machine may be operated a definite
length of time In a certain area and
the catches compared with - much
more accuracy.

be balanced for the account by levy
ing a tax on wage income and in
creased surplus earnings so aa to
stabilize but not impair purchasing
power. The social credit bank can
so control Issuance of social credit
dollars and withdrawal of social credit
dollars from currency stream , as to
contribute to stabilization of ptir
chaslng power. Stabilization chiefly

(UP) Ants were responsible for the
discovery of a rich gold prospect near
here. The mine Is 50 miles from Bula
wayo In a district .which had not
been prospected before. The gold reef
was several feet below the surface
and there was no outcrop ;o guide
searchers.

meeting will be held In the Elks
temple Thursday and Friday of this

codling moth Is pear scab. LeRoy
Child, superintendent of the Hood
River Experiment station, la one ot
the outstanding investigators of the
nature and control of pear scab. He
will d I scum this trouble in his talk
on Thursday and make recommenda
tions for ita control. Aa this valley
has suffered two pear scab attacks
on the past three years, Mr. Cordy
urges all growers to attend this talk
to become familiar with scab con
trol, whether or not they have been
troubled with it.
