the hands of President Roosevelt to
day hi commission as an associate
Justice of the supreme court.
The 111 -year old Alabaman, dressed
In a white summer suit, left a White
House luncheon conference with the
president carrying the commission In
a, cardboard container.
He said he had not decided when,
or where, he would take the consti
tutional oath, or who he would wk
to administer It.
He added, however, he thought he
would take the oath late today or
tomorrow.
He said he would resign from the
enate at about the time he was
sworn and that copies would go to
botn Governor Graves of his state
and Vice-president Garner.
He said he talked with Graves for
about five minutes today but would
not aay whether his successor as
senator was discussed.
He expressed belief. In response to
question, that the court petition
to prevent his assuming the bench,
filed yesterday by Albert Levitt,
former federal Judge, would have no
effect on his taking his new office.

CALLED Bl DEATH
John Jackson Wlnnlngham, resi
dent of Jacksonville for the past 69
years, died In his home at 11:50 this
morning after a prolonged Illness. He
was 74 years old.
Mr. Wlnnlngham was born in Ore
gon City In 1863. He came to south
ern Oregon In 1868 and had lived
here continuously since that time.
He was united In marriage to Miss
Mary Stella Mathews In Medford on
May 16, 1007. Eight children were
born. Surviving besides his widow
are: John Lee Wlnnlngham or Klam
ath Falls, Paul Wlnnlngham. Roy
Wlnnlngham, David Wlnnlngham,
Grace Gwln, Marian Cunningham and
Mathew Wlnnlngham, all of Jackson
ville; six grandchildren and three
brothers and five sister: Mark Wln
nlngham of Applcgato, Cal Wlnnlng
ham of Happy Camp. Cal., James
Wlnnlngi'tim of Jacksonville, Polly
Watklns of Applegate. Ada Hewitt of
Eureka, Cal., Minnie Baker of Van
couver. B. C, Ella Russell of Klamath
Palls and Pearl Whitney of Jackson
ville.
Funeral services are being arranged

cil approval, the routes will be chang

ten cents for an adult or three fares
for as cents, 1A for 91; children un
der five free; children between five
and ten, half fare; children going to
and from school, five cents or 30
tickets for $1.
