loney toda$ revealed that the su
preme court decision upholding the
validity of trie soctat security act
prompted approximately 800 delin
quent taxpayers In his district to
make returns under the provisions
or titlea VIII and IX of that act. The
latest payments totaled $1,059.325 57.
Plguies In the collector's office
showed that 11.309 employers filed
treasury form SSI In behalf of them
selves1 and their employees, paying
373.093.10 In taxej on the wa;es
earned in this district during '.he
month of May. This tax Is levied
under title VIII of the social security
Act, which imposes an Income tax
of one per cent on wages of "every
taxable individual" and on "every
taxable employer" an excise tax of
one per cent on the wages he pays
each of his employees.
In estimating that an additional
3000 employers were still Ignoring the
fact that they must pay the -one per
cent wage tax due from every em
ployer and employee. Collector Ma
loney pointed out that the law makes
the employer alone subject to penal
ties for failure to Uv returns and
make payments. The employer la also
responsible for the collection of his
employee's share of the tax, deduct
ing It from the weekly wages paid.
"Employers of eight or more per
sons who have not yet filed treasury
form G40 and paid the excise tax of
one per cent on their 1936 pay roll,
a called for under title IX of the
social security act, have already In
curred a 10 per cent penalty," Mr.
Maloney said. "There .Is no excuse
for continued delinquency under ti
tle IX. Ample notice Is given em

tax was due from them, and them

of employer to remember that offi
cers of corporations are counted as
employees for the purpose of taxa

DETROIT. June 9. (AP) The
first committee for Industrial organ
isation atrike In the Ternstedt Manu
facturing company gave General Mo
tors Corporation another labor prob
lem today.
Two of the eleven Ternstdt plans
here were closed by a sit-down which
began late yesterday. The company,
which manufacturers automobile
hardware for the parent corporation.
