WAflKINOTON, June 1. (AP)
President Roosevelt asked congress
today to top tax dodging "by a
minority ot very rich Individuals."

"Some are Instances of avoidance
which appear to have the color of
legality: others are on the borderline
of legality; others are plainly con
trary even to the letter or tne law
"All are alike In that they repre
sent a determined effort on the part
of those who use them to dodge the
psyment of taxes which congress
based on ability to pay.-
"All are alike In that failure to
pay results In shifting the tax load
to the shoulders of others less able
to pay, and In mulotlng the treas
ury of the government's Just aue."
The president urged congress to
confine Its tax legislating to plug
ging loopholes In present laws, re
Iterating an earlier suggestion that
there be no new taxes and no general
rate revision at this session.
He said the treasury would sup
ply by next November a general tax
survey, on the basis of which "the
congress may, If it chooses, under
take revisions of the tnx structure."
"The long-term problem of tax
policy Is wrnlly separnte from the
Immediate problem of glaring evasion
and avoidance of existing law," he
continued.
"In this Immediate problem the
deoency of American morals la In
volved. "The example of aucceseful tax
dodging by a minority of very rich
individuals breeds efforts by other
people to dodge other lawa, as wsll
as tax lawa."
The president said etlorts already
are being made to befog the tax
evasion Issue, adding:
"Already certain newspaper pub
lishers are seeking to make It ap
pearfirst, that If an Individual
can devise unanticipated methods to
avoid taxes which the congress In
tended him to pay he Is doing noth
ing unpatrtotlo or unethical; and.
aecond, that because certain Indi
viduals do not approve of high in
come tax brackets; or ffle undistrib
uted earnings tax, of the capital
gains tax, the first duty of the con
gress ehould be the repeal or re
duction of those taxes.
"In other words, not one but many
red herrings are In preparation.
"It la also a matter of deep re
gret to know that lawyera of high
standing at the bar not only have
advised and are -dvlilnj their clients
to utlllne tax avoidance devices, but
are actively using these dtvlcea In
their own personal affairs.
"We hear too often from lawyers,
as well as from their cllenta, tho
sentiment, 'It Is all right to do It
If you can get away with it'."
All three branches of government
are concerned Jointly with tax eva
alona. the president aald. Congress
should eliminate loopholes, he added
and the executive branch ehould In
vestigate fully all questionable cases,
prosecute where wrong has been done
and make recommendations for clos
ing loopholes.
"It la the duty of the courts."

give full consideration to all evi
dence which points to an objective
of evasion on the part of the tax

Whistles sounded the warning to
the people, who spent a sleepless
night In anticipation of the river's
second attack following torrential
rains In the Cap! tan and White
mountains yesterday.
Whether the waters, creeping In
through the western part of the
city, would reach or exceed the flood
stage of from two to fire feet of
last Saturday waa not known.
This morning the Tagrant river,
through one of its sudden whims,
divided the advancing flood west of
the city, shunting what observers
said was the major portion of water,
toward the southwest.
The city was well prepared for the
advancing waters when they arrived
this afternoon.
