CHASTITY OF LADY
MUST BE PROVEN
IN CHASTITY SUIT
LOS ANGELES. April 17. tjp
Before a woman can validly sustain
charge of seduction, the court of ap
peala held today, she must prove
that ahe was chaste at the time of
the betrayal.
The opinion was written when the
court reversed a aiO.000 judgment
awarded Mary Carter. 18. who charg
ed that Jerry Murphy, aalea corpora
tion executive, betrayed her.
Tha decision was written by Jus
tice Marshall F. McComb and con
curred in by Justices Charles 8. Cratl
and Walton J. Wood.
To back up his opinion concerning
chastity and seduction, Justice Mar
shall went back to a famous Oregon
supreme court decision of 80 years
ago. from which he borrowed these
words:
"The Individuality of the female
sex has been materially advanced
during tha past few years. Their
knowledge of the world has greatly
Improved and their legal capacity en
larged. "The notion that they belong to
the weaker sex is only entertained
by the credulous and unsophisticated.
They are not easily beguiled and
should be held to a reasonable re
sponsibility. "If allowed to maintain an action
for their own aeductlon, and to de
mand a large compensation for their
loss of character, they should be re
quired to prove something more than
mere Importunity as the means
through which It was accomplished.'
But that was a decision of half
a century ago, and Justice McComb
brought It up to date with this:
"It can not be doubted that with
the advent of radio, moving pictures
and the widespread dissemination of
Information regarding relationships of
mn and women, the female of 18
years today Is better Informed con
cerning the course of conduct which
she should follow In her association
with the opposite aex than was her
sister of 00 years ago."
