'T'HE text of ths Supreme Court decinion in the Wagner Act

, But it it known that the Wagner Act has been upheld in the
Associated Press, Jonea-Laughlin Steel, and the Interstate bus
cases.
And this ig enough to establish the decision, as an over
whelming and unexpected victory for the New Deal, and, a,
we view it s crushing defeat for President Roosevelt in his
determination to pack the Supreme Court.
Ths administration does not
complete enough to demonstrate, that ita program regarding
organized labor, can be carried out, in every important particu
lar, without changing the personnel of the Supreme Court, and
merely by changing the wording of certain phases, in the pres
ent measure.
The Supreme Court's decisions a week ago, presented a
strong argument, against the

president's attack on the Supreme Court, or some other mysteri
ous influence. This paper's opinion is President Roosevelt can
take ALL the credit, had he never built a fire under the court,
this Wagner Aot would in our
unconstitutional, as practically every constitutional lawyer, of
standing, familiar with the temper of the court, predicted, since
its passage.

those who refuse the president sny credit, who disbelieve In him
snd sll his works, and the other crowd, those who put their
brains in escrow and 1st him do their thinking. If there was a
middle group who admitted tho presldent'o nobility of purpose,
who admired his glsmorous courage, who conceded the wisdom
' of much of his snptratlons snd yet who could say no and smile
snd mean It, the country would be better off. But tho negatory
eectlon has been saying "no" for four years and scowling. These
people csnnot smlls. And the others take It out In grinning
snd hops for the best.
Bo the country la paralysed. Thua we atand In the presence
of something which msy bs the forerunner of dlrs calamity, thla
alt-down strlks, or which may bs Just another fad, another
nonsense like the dime chain letter madness. And the while

This public psychology hsa been brought home poignantly
to the present writer, ever since the Supreme Court proposal
broke.
The Mail Tribune at the very outset opposed this effort, ami
hss opposed it consistently ever since. Wc gave our reasons for
opposing it.
But because we didn't tear the editorial shirt and work our
selves into hydrophobiao rage damning the president in every
issue from hell to breakfast, we have been persistently accused
of being luke warm, yes and no-ing the issue, pulling our
punches and what have you.
MEANWHILE, from the opposite side has come precisely
the CONTRARY indictment:
"Why did you support th president during the campaign,
and then desert him Immediately otter? can't you TAKE It I"
It is all highly amusing of course.
But as Mr. White points out it does show sn unfortunate
cleavage in the country today, an inability to view either prin
ciples or personalities objectively; a blind insistence upon
eating raw meat and going to extremes, on one side, or the
other, and thus making slight if any progress.
IT hss been our opinion snd still is thst it is quite possible
to oppose this Supreme Court proposal, without calling the
president names, iuestioning his integrity, or denirinif bis imme
diate impeachment. More than that we regard it as equally
possible to oppose him on this issue, snd support him on practi
cally all others.
But this isn t ths popular course to pursue. Not by s jugful
lh truth slmost alirsys lies in
the two extremes, but the truth
calls the "middle group", and
American people get excited about something, is, in the mass,
practically non-existent. And the remnant that does survive
has to fight for its life, between the upper and nether millstones.
Which, -ss the distinguished Kmporia editor points out, is
unfortunate for the individual concerned, and the country.
