TEST OF LEGALITY
'(Continued from pa$ One.)
they are subject to suit In any court
of competent Jurisdiction where they
are commuting said illegal and un
constitutional acts, and where pro
cess can be served."
Tile power companies' suit was
brought originally In chancery court
at Kuoxvllle and transferred to fed
eral district court on the plea of
the TV A. Subsequently the TV A Med
a motion to dismiss contending that
under a section of the TV A act the
suit should have been brought In the
northern district of Alabama.
The act fixed the authority's legal
residence In that district.
Immunity Lost
"Certainly congress may create a
corporate agency for a lawful and
constitutional purpose," the court
said, "and In so doing may provide
the forum In which such agency may
be sued. And, so long as Its acts
within the constitutional powers
granted, It may now be sued else
where. "But, if the act be Invalid, or U
the agency assumes powers not con
f erred, It Is stripped of its Immunity
to. be sued In the forum designated
by the act creating it, and assumes
the role of an Individual, who is
answerable for his wrongs wherever
found.
"It Is hardly reasonable to sup
pose that congress intended to make
these defendants Immune from suit
In any jurisdiction except In the
northern Judicial district of Ala
bama for damages resulting by their
unauthorized acts of whatever char
acter. The bill alleged, among other
things, that certain power activities
of the Tennessee valley authority are
unconstitutional or that, if they are
not unconstitutional In all respects,
the directors of the authority have
exceeded their powers in many ot
their functions.

CHRYSLER ENTERS
LOW PRICE FIELD
Chrysler will enter the local low
priced field with the unveiling of
the new 1037 Chrysle Royal. In front
of Hunt's Craterlan theater tomor
row at 1:30 p. m., according to H. P.
Lange of the Lange Motor Car com
pany. Mr. Lange says: "The 1037 .Royal
Is new and entirely different. It has
a forward reaching style and true
fine car luxury. The new Chrysler
gold seal helps make the invasion
possible. It's a brand new engine,
with patented floating power mount
ings. It embodies not Just one or
two new features, It has everything
known to science. This new engine
not only excels in action and power,
but It actually delivers deluxe per
formance on an out tnd out saving
on gas and oil."
After the showing of the Royal In
front of the Craterlan. It will be
taken to the Lange Motor Car com
pany showroom, where the brilliant
new 1037 Chrysler Airflow will be
unveiled. According to advance re
ports the ncw exterior styling of the
1037 Airflow is matched by interiors
of supreme luxury and beauty.
"Beauty" Is the keynote of the new
Nash automobile line for 1037, which
are now on display at the Walter W
Abbey showroom, according to Mr
Abbey, who returned to Medford to
day with the new models.
Mr. Abbey says: "The new Nash
automobiles have a beauty that is
unsurpassed In the most expensive
cars. Everything about the new Nash
models marks them as genuinely fine
cars, cars that will stand apart from
all the others.
"With the Introduction ot the 1037
Nash La Fayette 4,00," Nash presents
to America a new kind of low-priced
car. A car that will onable thou
sands of former small-car owners to
drive a bigger, more beautiful, better
engineered car. yet a car that costs
little more than the lowest-priced
cars.
This Is made possible by building
Into the LaFayette "400' the remark
able,' 00-horsepowoT, monitor-sealed
motor that established such sensa
tional economy records in thousands
of Nash-bullt cars now on the road.
A motor that actually makes this
beautiful, big, 117-inch wheelbase
car cost less to run than many of
the smallest cars.'
Only three models are being manu
factured by Nash this year. Besides
the new LaFayette "400" there win
be an Ambassador Six and Ambassa
dor Eight.
