Clarence Burke, accused of the first
degreo murder of Roland Burr two
years ago and a fugitive under un
aasumed name until his recent ar
rest, was a free man today.
After deliberating five hours ar.i
ten minute, a Jury last night re
turned a verdict of acquittal and
Judge H. D. Norton ordered him
freed. "I can readily see grounds
for such a verdict," Judge Norton
said. "This has been one of those
cases where there was very reason
able doubt, and some of the testi
mony has been obscure.''
Burke said he will not go back
down the Rogue river to his gold
mine 46 mllea northwost of Grants
Pass or to tho slto of the cabin, now
burned, where Burr was killed and
Burr's partner. Martin Jennings,
wounded. Burr's body was later
found in the river.
Burke claimed he found Jennings
and Burr In hla cabin after he had
warned Jennings to keep away. De
fense witnesses estnbllhed that Jen
nings had a reputation as a thief and
"claim Jumper," and that Burke's
reputation was good.
Defense was based primarily on
credibility of Burke and Joinings,
and of Burkes' right to defond hla
property, counsel declaring that a
jury of miners of the district would
certainly acquit him. There, it said,
where food and tools must be car
ried on foot for many miles, prop
erty has increased Importance.
It made no attempt to show how
Burr met his death except that he
was with Jennings.
District Attorney Sherman S. Smith
lost his first plea for hanging aa hu
demanded "the rope" for Burke. He

The verdict was reached under the

killed, requiring unanimous decisions

the furnace room soon after an alarm
was aounded by a roomer In Mrs.
Goodwin's home. The roomer found
tha body across a cot, police said

A negro hall boy was the only per
son held by police. . No charge was
placed against him.
Mrs. Goodwin had been In the gov
ernment employ 16 years and In the
tieasury since 1031. she was a for
mer resident of Detroit.
Friends said she was estranged
from her husband, Benton Oood win,
about eight years ago. The husband
and Mrs. Goodwin's father. Prank F.
