Ware, 35, Springfield. Ore., showed
Improvement today after an opera
tion for a bullet wound in the back.
Ware was. shot as he slept In a
cabin near Port Orford last Tuesday
night. Stat police were told that
E. Roberts, 78, also of Springfield,
who was with Ware, had. a revolver
with him as protection against a
holdup and had a nightmare In
which he thought he was being held
up.
Roberts was detained at Gold
Beach, although no charges were
filed.
BERLIN, Aug. 28. (AP) A new
series of Immorality trials, similar to
those which begin last May at Kob

TRUCK KILLS DRIVER
BAKER. Aug. 28. ( AP) Floyd
Pollard, 48, was Instantly killed Wed
nesday In a truck accident on the
Baker Mill road near Cornucopia af
ter six men riding with him had
Jumped to safety.
Pollard was hauling a nine ton
ball mill from the Baker Mill site to
the Cornucopia Gold Mines company
a truck. The truck collided with
another on the hill and apparently
the clutch , slipped as the heavily
loaded machine went out of control.
Realizing he could not avoid a crash,
Pollard Jumped but apparently struck
an obstacle at the roadside and fell
back under the machine.
SALEM, Ore. (UP) An en 14,000
persons h&ve served time to Oregon's
penitentiary In 85 years.
The legislative act establishing a
penitentiary for the territory of Ore
gon was passed in 1851. The prison
was built In Portland, and was not
moved to Salem until 1806.
First Inmate In the penitentiary
was a redskin known as Indian Char
ley. He was sentenced to three years
for larceny In Marlon county. An old
book containing the prison's first rec
ords doesn't ,how when Indian Char
ley started his term. But he escaped
on December 3, 1853, and wasn't re
csptured until May 5, 185S, the book
revealed.
Then convict Ko. 1 escaped again
June IB, 1862. and never was heard
of again. Whether his term was
lengthened for his first escspe Is not
known, 1
By a strange coincidence, convict
No. 14.000 Is also from Marlon coun
ty, and also serving a term for lar
ceny. He Is Joseph Digger, who start
ed a six months' sentence August 13.
