cleared of the charges In a referen
dum election, though It was said the
poll against him would probably 'be
larger than his supporters anticipate
Summation of the case was com
pleted at 12:20 thlA morning.- 1m-
mediately Dr. Blake moved that the
charges against Mr. Adams be dis
missed. The motion was seconded by
Dr, 3. w. Gregg. -
Wiley A proves Dismissal
Mayor T. S. Wiley then addressed
the assembly, stating that the charges
against Mr. Adams had not been sus
tained, although all the business of
the' recorder's office had not been
conducted efficiently. He said, how
ever, that there were mitigating clr
j cumstances in Mr. Adams' favor so
far as his deficiencies were concerned
as he had been hampered and ha
raised In the perfai nance of his du
ties. '
The mayor absolved all members
of the council ot partisanship in the
squabble excepting Gerald H. Wen
npr, chairman of the finance com
mittee, whom Mr. Adams had blamed
for his predicament. It was the may
or's opinion the finance committee
Otlght to have fa new chairman and
that Mr. Adams ought to be per
mitted to continue as recorder with
out harrassment. If, under more fa
vorable circumstances, Mr. Adams
should prove to be Incompetent he
then should be removed from office,
the mayor said.
The air was full of drama aa the
mayor spoke and when he finished
he was roundly applauded.
Wants Public's Opinion
H. S. Ingle then took the floor and
declared that while he thought the
charges had not been sustained the
question of removal should be placed
before the public. His view were
concurred in by Mr. Wenner.
The roll was then called on the
motion to dismiss the charges. Dr.
Blake and Dr. Gregg voted In favor
of the motion: Guy Applewhite, L. H
Hnsen, Mr. Ingle and Mr. Wenner
voted against the motion.
It was pointed out after the meet
ing that should one of the four vot
ing against the motion change his
attitude at a subsequent council
meeting, the charges would probably

a tie vote with the. mayor casting
the deciding ballot. The mayor In-
dlcated by his talk last night he
would vote for dismissal of the
charges.
Lawyers Battle
Another attorney entered the fray
last night. He was William Brlggs
of Ashland, who apepared aa counsel
for Mr, Wenner and Mr. Hansen, both
members of the finance committee
'jthat filed the charges against Mr.
Adams. At times during the pro-
longed hearing it was doubtful who
really was on trial. Sometimes It ap
peared to be Mr. Wenner or W. S.
Whiting. Portland accountant engag- I
ed In installing a new accounting 1
system In the recorder's office, whom '
Mr. Adams held largely responsible j
for his difficulties.

argument. The hearing resumed with
Mr. Adams as wltnesa and when his ;
counsel, Don Newbury, sought to in
troduce letters from Mayor WUey to I
Mr. Adams. Mr. Brlggs objected. The

then Mr. Brlggs asked that the mayor ;

Mr. Brlggs whereupon a sharp word
battle ensued among Mr. Brlggs, Mr.
Wenner and Mayor Wiley.

In a court at an Informal hearing ,
it was permissible to present Mr. Eu- ;
banks' rebuttal evidence. Mr. Eu
banks testified regarding alleged de
ficiencies in Mr. Adams' accounting
The case-ln-chlef was completed
at 11:09, whereupon counsel agreed
among themselves regarding allot
ment of time for summations. It was
agreed the prosecution would be al
lowed 40 minutes in all for opening
and closing arguments. Defense was
allowed 30 minutes for one address.
Kenneth Denman, attorney for Mr
Whiting, opened for the prosecution
and Mr. Brlggs gave the final sum
mation. Mr. Newbury gave the de
fense summation, all the attorneys
reviewing the evidence and arguing
In behalf of their respective clients.
Mr. Van Dyke was named timekeeper
by Mayor WUey and a little horse
play was Introduced when the city
attorney, unable to find a stopwatch
or a referee's whistle, littered the
council table with all the pocket and
wrist- watches he could gather.
An even larger crowc attended last
night's session than on the three
previous nights, It being estimated
that 300 were present. The specta
tors stayed until the end of the ses
sion early this morning. The throng
again was demonstrable but was held
in check by Mayor WUey. who stated
at the beginning that he would be
more strict In preventing demonstra
tions as he had been criticized for
permitting too much applause for
Mr. Adams..
this morning and he was in pood
spirits. He was not despondent."
Mather said that Norton graduated
from the University of Texas and had
been with the securities exchange for
several months.

PALLS 10 DEATH
HOUSTON. Tx., Dec 30. (AP) P.
T. Norton, Jr 2fi, of Port Worth, Jun
ior attorney for the federal securities
exchange commission, plunged from
the tenth floor of the Rice hotel to
day, dying a few minutes later.
Norton registered at the hotel Wed
nesday. He was In the city on gov
ernment business.
Richard N. Matber, also of Fort
Worth and the senior attorney with
the securities exchange commission,
