SLIM CHANCE TO
GET DEATH DELAY
WASHINGTON, Dec. 7. (API
Competent supreme court observers
tonight gave Richard Bruno Haupt
mann but one chance In five, at best,
of gaining any delay from the high
court in his fight against a sentence
of death for the kidnaping and mur
der of Charles A. Lindbergh, Jr.
Estimates of Hauptmann's chances
for a supreme court delay ranged
from one out of five to one In one
hundred.
The estimates were based on obser
vation of previous supreme court rul
ings in similar criminal case pleas.
Except in most extraordinary circum
stances the high court has not. In
the past. Intervened.
In addition to acting on Haupt
mann's plea, the court is expected to:
1. Decide the right of the federal
government to punish In the federal
courts persons who steal cotton from
banded warehouses under the cotton
warehouse licensing act.
2. Decide the right of building
and loan associations with state char
ters to transfer to a federal charter
without state consent.
Both of these Issues, Involving a
conflict of federal and state powers,
may prove of great significance as
far as the New Deal Is concerned.
Immediately after reading opinions
the court will hear argument on the
validity of the AAA.
