holding the Multnomah county cir
cuit court's decision that the Btat
agricultural adjustment act was un
constitutional, were filed In the
state supremo court today by attor
neys for Fred Meyer, Portland chain
store operator.
The suit was originally brought
against Meyer to restrain him from
selling Ice cream at a price below
the minimum set by the code, and
Clrcutt Judge Winter held the code
unconstitutional. The case was lm
mediately appealed to the higher
court.
In the brief filed today Meyer con
tended that the code was formed by
manufacturer and distributors, and
that It raised the price of ice cream
from 29 to 40 cents a quart, and

of the increase."

score. The latter is showing a gen
erally steady tone, although here
and there some weakness Is showing
for lower grades.
There was no change In price for
the day.
The egg market remained un
changed, with demand good for real
quality and slow for inferior stuff.
Scarcity of light weight broilers
continued and prices held relatively
high. Oeneral live chicken trade
was practically unchanged.
Boom in tomato market prices
here was the result of Inability oi
the trade to secure its Increasing
needs. Sales were made to $1.20
box.

Editorial Comment
The pardon and parole racket. Is
a vicious one In any number of states.
Clever lawyers use friends and rela
tives of prisoners as dupes and shake
them down for sizable sums. Some
times they "spring" the prisoners:
freqtiently the money Is pocketed and
the prisoner stays behind the bars.
The latter cases have a bad rebound
and it is from such cases that the
district attorney of Marlon county
can get witnesses. We have no sym
pathy either for the parole officers
or the attorneys who connive such
plots. A full exposition of their ac
tions is due and the law should be
salutary In punishment tf they are

j bribe. Kellaher was notorious when
parole officer in seeking the release
' of prisoners. Fortunately a number of
! cases were overruled In the governor's
office but altogether too many hard
! boiled, dangerous criminals were re
; leased because this soft-hearted, cun
1 ning Irishman recommended freedom,
j The expose of his 850.000 contract
with L. A. Banks under which he was
i to Beek executive clemency for the
Medford murderer, gives the Marlon
I county grand Jury ample opportunity
to dig up the facts about pardons
and paroles granted during Kellaher's
i regime.
j Kellaher came to Salem as one of
the old George Joseph crowd, a niun
j who could always be counted on to
: deliver the north end of Portland
' when Joseph was carrying out his
1 political plots. Governor Meier ap
; pointed Kellaher out of sympathy for
I his deceased friend. Kellaher did In
calculable harm to the state and it
j now appears that he sought to feather
his own nest in doing It.
Scandal
Oregon has had no scandal of re
cent years comparable to the revela
tion in Salem at the Banks hearing
concerning Dan Kellaher. This man,
while still in the pay of the state as
parole officer, is said to have bar
gained with a prisoner for payment
of a large sum of money for obtain
ing his release.
It will be recalled, first that Kella
her was a Meier appointee, and sec
ondly that an unusually large num
ber of pardons was issued during the
Meier administration. It is not easily
conceivable that a man would stoop
so low as to carry on a traffic In par
dons but the record, under the cir
cumstances, needs a thorough investi
gation. One of the Interesting phases of
this case Is the fact that the hearing
demanded by that home-made radical,
Dick Ncuberger and his associates
was completely smothered by the
stench of scandal. It was an ill-conceived
affair from the outset. (Rose

The toll of destruction from Ohio's
worst flood In 22 years mounted
higher today as the crest of the
swollen waters here moved on toward
the Ohio river.
With two persons known to have
drowned, another missing, and three
others dead as indirect results of the
flood and the series of storms that
preceded it, unofficial estimates or
property damage ranged upward to
day from 93,000.000.
More than 1000 persons who re
sided In the path of the flood now
are homeless and other hundreds are
under orders to flee for safety to
higher ground.
