Oregon, there was duly submitted to 1
the legal voters of said City at the ;
special city election duly held In avnd

rember. 1034, a charter amendment
amending the Charter of the City of
Medford. by adding thereto a new
section to be known as Section 72-J.

SECTION 73-J.
Sec. 1. The City of Medford here
by Is author Iced and empowered to
construct, build, equip, own. acquire.
within or wit bout the corporate limits
of the City of Medford. Oregon. In
whole or in part, a sewage treatment
and disposal plant, and the facilities
thereof, and to provide a sanitary
means of disposing or the sewage or
said City, with all appurtenances
necessary, useful, or convenient for
the treatment and disposal of sewage

Sec. 3. The bond hereinbefore
authorized shall be known as "8ew
age Disposal . Bonds." The Council
may determine the maturities, form
and tenor of said bonds, provided
however, that such bond shall be
serial in character In accordance with
any provision of law or the Charter
of the City of Medford now. or wh:ch
may hereafter be in effect, and shail
be payable in not to exceed thirty
value thereof with accrued tntere.it
and shall bear Interest at not to ex
ceed 4' per annum payable semi
annually. Such bonds shall provide
for the payment of principal And
interest thereon from service char

Sec. 3. The Council shall have,
and hereby is granted power and
authority to establish Just and equit
able rates or charges to be paid for
the use of such sewage disposal plant
facilities, by each person, firm or cor
poration whose premise are served
thereby, or upon subsequent services
thereto and said rates or charges shall
at all times be sufficient to service
any bonds Issued hereunder and to
create a reasonable reserve. The Coun
cil may provide for the collection of
such charges or rate by charges
against each water user from the
water system of ths City of Medford
having sewage connections, a month
ly charge or rat In addition to the
charge for the sale or use of water
from said water system. Such month
ly charge ahall be collected from and
paid by each water user having sewer
connection to the water from said
water system. Such monthly charge
shall be collected from and paid by
each water user having sewer con
nection to the water commission of
the City of Medford, with the ranus
or charges fixed by It for the 'ise
of water and paid over by said com
mission to the city Tresaurer. in
lieu of. or In addition to the nuu.r
of collecting such charge as herein
before provided, the Council may
adopt any other manner or method oi
collecting tne same, ana make an
necessary rule and regulation for
the use of said sewage disposal fa
cilities and for th collection of the
rate o; charge for the use thereof

sewage disposal bonds, and the prin
cipal thereof at maturity, and the

surplus earnings, if any. be used to

be set aside a sinking fund alull
constitute a first charge upon the
gross revenue received superior to
