'Epic' Backers Win 17 Seats
in Assembly Call to Bat

battle for control of the Democratic
party In California 'loomed today aa
Upton Sinclair, defeated nominee Scr
governor, rallied his "Epic" foreea to
consolidate a foothold gained in state
offices.
Though Sinclair's own bid was
burled in Tuesday's avalanche of
votes returns from 10,251 of 11.721
precincts showing him trailing He
publican Governor Prank P. Merrlam
1,071,318 to 833,312 other "Epic"
Democrat candidates fared better.
Culbert Olson, Sinclair's chief cam
paign lieutenant, was elected to the
state senate, and "Epic" backers cap
tured at least 17 seals In the assem
bly and one of the four coveted places
on the state board of education im
portant tax and liquor control body.
Battle Crv sounded.
The call to battle for control of
the party was Issued by Okon In Ills
capacity as Democratic state central
committee chairman a post to which
he was named after Sinclair won the
party's nomination In the primary
election.
"Only those who remained loyal to
the Democratic party during the re.
cent camnaiiin will remain In th-i
party and be recognized as Demo
crats." Olson declared following a Lew
Angeles meeting at which Sinclair
acted as chairman.
The challenge was accepted by Wil
liam B. Neblett, Los Angeles, law
partner of United States Senator Wil
liam G. McAdoo, and William Jen
nings Bryan, Jr.. both of whom re
fused to support Sinclair for the gov
ernorship. Neblett declared that the "Demo
crats will repudiate Epic." and Sin
clair retorted "the Democrats will :e
pudlato Neblett."

once the national leader of the party.
declared: "Upton Sinclair, who Is
not now and never was a. Democrat,
must no longer be regarded a leader
in the Democratic party. Hia Inva
sion has been repudiated."
McAdoo Aloof.
As the hostilities were opened, Sen
ator McAdoo remained aloof. He said
he "voted the Democratic ticket all
the way through," and expressed be
lief that Sinclair "would have been
elected governor of California if he
had consistently adhered to the Dem
ocratic platform adopted at Sacramento."
Senator McAdoo hailed the party'
national victory, which included the
election of 12 possibly 13 cohgresj
men to California's 20 seats, as a ver
dict for the new deal. "The Repub
lican party Is dead," he said.
The doubtful California seat In the
house of representatives was in titc
12th district, where John'N. Hoeppel,
Democrat, was leading his Republican
opponent, Frederick Houser, 43,645 to
42,028, In returns from 365 of 430
precincts. If Hoeppel wins It will he
a gain of two in the state's represen
tation for the party.
