Refuses to Formally Concede
Defeat Charges Votes
Stolen Recall Threat Is
Voiced by Ex-Socialist
BAN FRANCISCO, Nov. 7.- (AP)
Far behind the ballot count of Act
ing Governor Frank F. Merrlara In
the race for the governorship, Upton
Sinclair, Socialist turned Democrat,
today threatened to launch a new
campaign to "end poverty In Califor
nia,
Refusing to concede defeat form
ally, Sinclair congratulated his oppo
nents xor their "brief victory" and
declared "this election has Just been
a skirmish and our people have en
listed lor the war,"
Merrlam's running mate, George J.
Hatfield, who apparently won. the
lieutenant governorship over Sheri
dan Downey, Democrat, declared
"radicalism has been defeated," while
Sinclair retorted "tens of thousands
of workers all over the state" would
watch keenly to aee "wether Mer
rlara kept his promise about the old
age pension and the 30-hour week."
Hints at F. H. Conference
Sinclair gave the first hint of his
recent discussion with President
Roosevelt by declaring the chief ex
ecutive had promised to broadcast to
the nation "on the principle of pro
duction for use," a major tenet of
the "Epic" plan, as -opposed to pro
duction for profit.
The former Socialist also charged
that votes had been "stolen" and
his campaign managers added they
were not satisfied with the reports
about the returns. They expressed
the belief that large numbers of bal
lots had not been counted and there
fore they would not make any for
mal admission concerning the elec
tion of Merrlam.
"Remember that we have the power
of recall in this state, and If a Re
publican reactionary becomes gover
nor of this state we will have that
recall power hanging as a sword over
his lead," Sinclair said.
Governor Merrlam, Iowa bom farm
boy, aold his victory was one of
"Americanism over radicalism."
Merrlam Pledges Aid Poor
He Issued a statement pledging
himself to relieve economic distress
and encourage the processes of eco
nomic recovery, declaring his election
as governor represented, "definite and
positive adherence to sound and test
ed methods In government and In
economics."
"We have demonstrated the essen
tial common sense of the people of
California," ho said.
Only two Republican led In the
congressional race, with the Demo

ahead. 4Mrs. Florence P. Kahn of the
fourth district was conceded victory
by her Democratic opponent, Chaun

Big Vote for Johnson
United Statu Senator Hiram W.
Johnson polled a tremendous major
ity over George Klrkpatrlck, his So
cialist opponent.
The Issuance of 154,000,000 ot new
bonds also apparently had been ap
proved. Of these, S30.000.000 was vo
enable veterans to purchase homes
and farms, and S24,000,000 was for
unemployment relief.
A proposition calling for local op
tion apparently was beaten badly,
while voters on the lacs of returns
approved liberalization oi the old
liquor control act permitting by-the-drlnk
sales of liquor by bona fide
cafes and hotels.
