Cite Court Records
That teatlmony ihowi that on the
evening of February 30. 1033, Earl
S. Fehl and his wife, Electa A. Fehl,
and aeveral other witnesses testified
that between 8 and 7 o'clock on Feb
ruary 20, 1033, said Fehl left his
home on South Oakdale avenue In
Medford, Ore., and came to my home
at the corner of Eleventh and King,
where he remained talking to me
about a tax matter until almost 7:30,
His testimony further shows that I
waa Just about finishing my even
ing meal at the time he came to
my home, and, aa a matter of fact,
I was not out of my house on the
evening of February 30, except once
for a period of five minutes when
I went to the home of O. c. Murray,
across the street from my home, to
use his telephone, Immediately re
turning to my own home where
remained the balance of the night.
I recognize the language of Earl
H. Fehl throughout both of the affi
davits and I bellove that he drew
the affidavits and prevailed upon
Bunch, likewise a convict, to sign
them.
In addition to the above, Burley
Sexton was not arrested until 6
o'clock on the afternoon of February
31, 1033, and he was arrested In the
court house of Jackson county, Ore
con, by Chief of Police McCredle.
The officers who talked to Bunch
tn Roseburg were Chief of Police Mc
Credle and James O'Brien, then
tat police officer, and I have been
Informed by Chief McCredle that at
aid time said Bunch told Chief Mo.
Credle and Mr. O'Brien that he did
not know any of the parties who
were In the Jail on the evening of
February 30, and that be knew noth
ing whatever about the ballot theft,

Police McCredle and Officer O'Brien
In the office of the sheriff of Doug
las oounty in Roseburg. I have known
Clatoua McCredle for over alx years,
have had occasion to cross examine
him upon numerous occasions and I
have never known Mao to tell a
falsehood, so that I know that Bunch
deliberately lied when he aald a po
liceman offered him a bench parole
for perjured testimony. Anyone who
knows Chief of Police McCredle knows
hut Bunch's affidavit la a deliberate
falsehood. Aa to Wilbur Sexton be
ing carefully looked upon on Feb
ruary 91, aa claimed In Bunch's affi
davit, I have learned that Wilbur
Sexton was not even arrested until
February 33. ,
Fehl Is oullty
Far from being an Innooent, promi
nent oltlrnn Earl H, Fehl Is one of
the guiltiest, double crossing citizens
that It has ever been my privilege, or
rather misfortune, to have been asso
ciated with. To show you his caliber,
I will cite one Instance, He was sued
by Roy M. Parr for libel and a Judg
ment obtained by Mr. Parr In the sum
of 13,000.00. Among others, I was
one of the attorneys foolish enough to
go to his defense, and I believe all of
the other attorneys who were asso
ciated with me in the defense of that
case will agree that they were like
wise foolish for so doing. Some time
In the summer of 1033 or perhaps
earlier, Fehl,. through his "Chief
Counsel," A. O. Hough, of Grants
pass, Oregon, who by the way had
taken no part In the original trial of
the ease, settled the Parr Judgment
for the sum of approximately $930.00,

although Herbert Hanna and myself
were two of the attorneys who origin
ally defended Fehl In the action. Fehl
continued to allow Hanna and my
self to work on his appeal In the Parr
case after It had been settled and the
Judgment assigned to bis mother-in-law,
Corlnthla E. Stale?. He contin
ually pled hard luck that he didn't
have money enough to pay for the
transcript of the testimony and asked
us how ' we were coming with our
brief, long after the case had been
settled and assigned to his mother-
ln-lsw and I did not know until his
trial was pretty near completed In
Klamath Falls that aald case had been
settled. I found out then through
Hough and not through Fehl.
Tried Betrayal of Pals
After Fehl waa convicted In twelve
minutes by a Jury of good citizens of
Klamath Palls he requested that I
secure affidavits from Walter J. Jones
and T. L. Brecheen that they had
planned the ballot theft and that he
had nothing to do with It, I Informed
Mr. Fehl that Walter J. Jones ani
T. L. Brecheen were Just as much
clients of mine as was Fehl; that I
had never double-crossed a client of
mine In my twelve or thirteen years
practice and that I was entirely too
old to start double-crossing.
As another instance of Fehl's hon
esty (?????) at the time Mr. Nleder
meyer foreclosed his mortgage against

Mr. Fehl, who la a radical prohibition.
1st, became possessed of a bottle or
whiskey and went to the home of J.
B. Thomas In Ashland and led Mr
Thomas to believe that Nledermeyer
waa foreclosing upon all of the build
ings at the corner of Sixth and Ivy
streets, stating to Mr. Thomas that
he was about to lose $30,000.00 worth
of property on approximately five
thousand dollar mortgage, and pre
vailed upon Mr. Thomas to lend him
the sum of $3000.00 for which he gave
his Demand note and drew an agree
ment whereby Mr. Thomas and Mr.
Helmroth were to bid In the building
at the Sheriff's Sale, take the certifi
cate of said Sheriff's Sale In their
name, the same, however, to be left
in the office of the Oounty Treasurer
for a period of one year until the
time for redemption had expired, aald
Fehl agreeing in the meantime to pay
the amounts of money Which Mr,
Thomas had advanced for the pur
chase of said property at aald Sheriff's
Sale. The year's period of redemption
expired on or about January 10, 1834,
and at the request or J, B. Thomas I
went to the office of Mr. Walker, thi)
County Treasurer, and demanded the
Sheriff's Certificate so that I could
obtain the Sheriff's Deed for Mr.
Thomas and Mr, Helmroth. Fehl hai
written on the envelope In Mr. Walk
ers office that the Certificate waa to
be delivered only to he or hi wife,
Electa A. Fehl, and thereupon Mr.
Walker refused to deliver aald Cer
tificate to me.
Trickery Uncovered
That, thereafter, and on or about
the loth day of April, 1034, Mr. Helm
roth having In the meantime retain
ed Mr. Oeorge Nellson aa his attorney,
Mr. Nellson and I went to the office
of the Oounty Treasurer and made
demand for the Sheriff's Certificate
of sale, and after Mr. Thomas and
Mr. Helmroth agreeing to hold Mr,
Walker harmless aa to any autt or ac
tion that might be instituted by aalit
Fehl, we obtained possession of
said Sheriff's Certificate and on th?
same day got Sherlff'a Deed to th-'
property.
At the time the money was advancer!
by Mr. Helmroth and Mr. Thomaa.

taxes were paid upon said property, a
statement he knew at aald time to he
false; he also stated that It was t'w

have alnce learned that there are up
wards of 11300.00 unpaid taxes against
said property.
If auch double-crossing methods,
so practiced by Earl H, Fehl as abovo
outlined, constitute a "Black Crim
inal Political Plot" by ths district
attorney's office against him, we wilt
have to seek further than Webster's
dictionary to find such a deflnlton
of criminal plot, I have probably
been as active In the trial practice
of the law during my over alx years
residence In this city as any other
lawyer, but even a lawyer feels hurl
when someone he supposed to be a
friend and whom he supposed to
be honest turns out to be not only
dishonest but crooked. I have never
minced words and have always
spoken my mind, and It Febl or his
wife desire to resent the fact that
I aay, at least, he Is dishonest, I
welcome the opportunity of arguing
the matter with him In court or else
where. As for Bunch, he Is only a petty
larceny convict, for whose opinion I
care nothing.
Incidentally, I may add that I never
was a member of the Good Govern
ment Congress or The Committee of
One Hundred. I love my Independ
ence too much to be dictated to by
any Individual, group of Individuals,
or association of Individuals. When
I waa first admitted to the bar and
took -the oath which la required of
all attorneys who are licensed to
prscttce, that oath meant something
to me and I have always endeavored
to, and believe that I have, lived up
to the letter of that oath.
Perhaps I have made this letter
unduly long, but I feel that the
people of Jackson county are entitled
to know what kind of a person Earl
H. Fehl Is.

the time Fehl waa county Judge,
which might also be Interesting to
the voters of Jackson county.
Sent to Camps A number of Ore
gon CCO boys, on 'duty at headquar
tera, were yesterday assigned to re
port to various camps In the district.
Wlllard L. Coffman, Robert Heuu
worth and August B, Slngler, all will
go to Camp Dog Lake. Earl B. Irwin
Is being assigned to Company 1596 at
Camp Annie Springs. Herman E.
Flynn, now on duty at Camp Hilt, in
northern California, will report to
headquarters detachment for duty.
Returns from Seattle Mrs, Julia
Mitchell, who was called to Seattle
recently by the death of her brother,
Curtis Abbot, hss returned to this
city. She la staying with the J. F.
Wortmans, who reside on the Pacific
highway" south of Medford.
PARK OFFICES TO
LAKE TOMORROW
Another Indication that the aum
mer aeaaon la fait approaching the
Crater Lake national park office will
move tomorrow to Government Camp
in the park, after having been located
In Medford ilnce last November.
The mild werther of the past, win
ter has left a minimum amount of
snowfall which facilitates the mov
ing of the office at this time of the
year, the earliest on record. Just a
year ago snow waa still ten feet deep
at Government Camp and at the
present time it has practically dis
appeared. Local people wishing work at the
park are requested not to drive to
Crater Lake at this time to make
applications, as no authorization has
yet been received from Washington,
O. C, for summer projects. As
soon as such authorization has been
received, It will be announced
through the press. As far as appli
cants for work at Crater Lake mak
ing the trip at the present time,
there will be no encouragement for
them when they arrive in the park.
It Is possible applicants will be
cleared through Medford to avoid the
necessity of the 160 -mile round trip
to the park.
With a point par basts of play In
suring all entrants an equal chance,
the mat tournament which is under
way at the Rogue Valley Golf club
Is proving a real treat to those who
are participating, and at the same
time supplying the course with six
badly needed mats for the tees.
The winners of the tourney will
have their names attached to the
new mats and, Just to show that the
women players are also supporting
the event, one of the prizes will go
to the winner of their contests. En
trance fees go entirely to Improving
the course, which dub members are
anxious to get Into the best pos
sible shape for the coming Jubilee,
when a host of visitors are expected.
Those who entered the tournament
yesterday afternoon and were unsat
isfied with their scores, will be able
to pay the fee of 91 and try again
today. Larry Schade. chairman of
the tournament committee, an
nounces that club members "may as
well play," because those who don't
will be called upon personally by
the committee and asked for a do
nation of a dollar or more to help
pay for the mats. Those who play
more often than most are also ex
pected to dig deeper than others, as
the course must be put Into top
notch shape before the Jubilee, both
to Justify the pride of the club mem
bers and to favorably Impress Jubilee
visitors.
Still Seriously 111 Miss Dorothy
Reynolds, instructor in the Ashland
schools, who haa been seriously . ill
for thfl past ten days at the Sacred
Heart hospital, waa yesterday reported
somewhat improved, but still In a
serious condition.

Helen Seraphlne Marlon
Helen Seraphlne Marlon passed
away at their borne three miles north
of Central Plont. Friday afternoon,
after a long Illness of tumor of the
brain: aged 85 years, 4 months and
30 days: born at Rolett, N. D., De
cember 18, 1898. Helen 8. Marlon
waa married to Norman A. Marlon,
November 31, 1823, at Plentywood,
Mont., and had resided In the Cen
tral Point dlBtrlct for the past 11
years. She leaves her nusband, Nor
man A., and one daughter, Norma
Lee. aged B years. Requiem mass
will be offered at Sacred Heart Cath.
