Manning was being questioned In
an effort to discover a motive for his
actions. The attorneys were not
known to be enemies.
Says Duel Fought
Manning said there had been a
duel In the office and Investigators
discovered- two bullets In a bookcase.
The shots were believed from the gun
held In Horan's hand Inasmuch as
both revolvers had two empty shells
In the chambers.
Horan was hit twice. One bullet
struck, his chest and entered the
heart. The other shattered his left
arm.
Manning telephoned Rex McMillan,
deputy sheriff at the county jail, tell
ing him to "come and get me."
"Ralph and I have had an argu
ment and there has been some shoot
ing. He took a couple of shots at me
and I shot him, I'm afraid he Is
dead." Manning told McMillan.
The veteran trial attorney waited
for the officers In the anteroom. The
shooting occurred In Manning's pri
vate office as the two men apparently
conversed across a desk.
Killed Instantly
' Both Manning's and Horan's chairs
were pushed aside and Horan's body
was found face down directly In front
of the desk. Dr. George Adler, coro
ner, said he died Instantly.
The legislator had Just returned
from Klamath agency where bis wife
is recovering from a serious Illness
at her parents' home. A doctor and
a special nurse left for the agency to
Inform her of the tragedy and It was
feared she was near a state of col
lapse. Horan coming here from Tennessee
six years ago to Join his father who
died a year ago, was one of the most
prominent lawyers In the county. He
was elected to the state legislature In
1933.
Several years ago Horan was a
member of the Manning. McColloch,
OrlscoU and Horan law firm. He Is
survived by his wife, a son Tommy, 3,
and a daughter a few months of age.
Manning has a daughter, Elizabeth,
living In New York City. He also has
a son James teaching school at 811
verton and a son Horace living here.

there for two days. Warner Baxter's
starring role In the film is heralded

band's charming sweetness Is Impos
sible for her to penetrate. The hus
band welcomes her lover with open
arms. The Englishman's admiration
for the husband becomes so great,
that he feels his presence Is an injus
tice and so he departs. The young
wife realizing her grave mistake re
turns once more to the love of her
husband.

Pleas of men Indicted by the last
grand Jury will be heard late this
afternoon by Circuit Judge H. D.
Norton, who today resumed .hearing
of Jackson county court matters,
after a month's session In Grants
Pass.
The court has named Attorney M.
O. Wllklns as counsel for Robert
Minor, Indicted for attempted bur
glary, and entered a plea of not
guilty. Minor Is charged with at
tempting to enter the Strang drug
store through the skylight.
John Weldman, charged with grand
larceny, had Attorney Newton Cha
ney named by the court to defend
him. Weldman also faces a federal
I liquor charge.
LeRoy Wright, Indicted for liquor
law violation, Is also expected to
enter a plea today. His partner,
Philip Hale, has entered a plea of
guilty. Wright Is the father of nine
children and bears the reputation of
being a hard working and industri
ous man. He lives on the Old Stage
road, and Is at liberty on bonds pro
vided by neighbors.
The criminal docket for the term
starting Monday, February 27, will
be arranged as soon as all pleas have
been made.
Not guilty pleas .have been entered
by Alfred Poston of the Plnehurst
district, charged with threatening to
commit an assault with a deadly
weapon during a dispute over game
laws with a state policeman last fall.
Poston is a well-known resident of
the eastern part of the county.
James L. Garrett, charged with
assault with a deadly weapon, will
also face trial. Garrett la alleged to
have ahot a woman In the leg w.hen
she attempted to leave with a Jug
containing whiskey during a party.
Garrett lives on the Butte Falls road
No disposition has yet been made
of the case of James L. Coleman,
Indicted for non-support and for
gery. The latter charge has been
dlsmussed. Coleman offers to return
to Arkansas with his wife and three
children, where he claims he has a
farm. He has been residing In the
Central Point district the past three
years.

Ashland; white in the evening, the
Medford negative, composed of Irene
Stubblefleld and Mildred Drury, will
meet the Ashland affirmative. The
debate Thursday evening will be held
In the high school auditorium, start
ing at 8.
Prof, walfred Dahlberg of the Uni
versity of Oregon will serve as critic
Judge. He not only will decide each
Individual contest but also the dis
trict winner, from the forthcoming
series. Last year Medford not only
won the district final but also the
state championship. The Ferry twins,
Frances and Elizabeth, have been
graduated but three members of the
squad last y ear remain, namely.
Dolph Jones, Cleo Hicks and Irene
Stubblefleld.
The public Is urged to attend the
debate In the local auditorium and
hear an Interesting discussion on the
question: "Resolved, that the U. S.
Should Adopt the Essential Features
of the British System of Radio Con
trol and Management."

10 TO TEACH CCC
BOYS IN DISTRICT
CCC district headquarters this
morning announced that funds are
now available for educational In
structors In the CCC camps, ten of
whom will be on duty In the Medford
district. Appointments are to be made
by officials of education, In the de
partment of Interior. The instructors
are to be paid 140.25 a month.
In each camp, an additional rating
will be made for an assistant leader,
to be selected by the camp educa
tional advisor. The assistant will be
paid $6 additional each month.
Headquarters also announced that
54 has been allotted each camp for
educational supplies and equipment
for a three months allowance.

STAGE OPERATOR FINED

Fred W. Bartley, operator of the
Jacksonville stage, was fined 925 and
costs by Justice of the Peace WUHp-m
R. Coleman, for violation of the auto
laws, on three counts. Bartley was
charged with having Improper license
plates, no chauffeur's license and no
public utility permit. Evidence was
heard by the court last Saturday
afternoon and a decision rendered
today. 1

the National Planning board, was a
recent visitor In Medford, and ad
dressed a meeting at the Chamber of
Commerce, at wlheh time the coumv
court, representatives of the city
council, the chamber directorate and
the city planning commission were
present. At the Introduction of his
talk. Mr. McClura paid a high tribute
to Larry Schade and the plannlnR
commission, and stated that the work
done In Medford was comparable to
that of Seattle and Tacoma. which are
supposed to be outstanding examples
in city planning work.
Mr. MoClure gave an outline of the
future of CWA program and explain
ed in detail a new idea known as the
city inventory program. He stated
that under the direction of the cltv
planning commission, cities were
making Inventories which would act
as guide In recommending further
CWA projects. He suested that this
be done In Medford. especially in vie
of the fact that this city has accom
plished certain work along this lino
already. Mr. Schade assured him that
It would be done Immediately,
Mr. McClure also suggested that a
county planning commission be ap
pointed so that in future development
work of the county a better and moro
harmonious program could be formu
lated by having the city and county
planning commissions work together
Many valuable suggestions were of
fered by Mr. McClure upon which th-)
city planning commission will wo-k
Immediately and which will, when
consummated, be the means of bring
ing about certain development here.
A meeting of the planning commis
sions of Montana. Washington. Idaho
and Oregon will be held In Portland
March 5, 0 and 7. These states com
pose region number 0 and the con
ference will be of extreme benefit to
thos attending. Mr. McClure urged
that Medford be represented at the
meeting.
