AKRON, O. (UP) It happened In
rubber factory here and It may
temper the whole outlook of burly,
na 11 -chewing, six-foot foreman con-
cernlngf actory management, produc
tion and perhaps straw-bossing gen
erally. The foreman, reading recently that
large automobile factory required
al its workmen to stand up during
working hours In obeisance to the
Great God Efficiency, decided to fol
low.
"Prom now on.' he ordered his
gnng, "you work standing up. No
etttln around loafln. D'ya get It?"
Two days later the foreman was
going about hl work as usual. Sud
denly he saw a man fussing over &
handful of wires seated on a box.
The effrontery burned the foreman
to the core. Saying nothing, he walk
ed over to the workman, and with a
hefty kick, sent the box out from
under him, sprawling the worker on
the floor.
The man pulled himself up. aimed
carefully and socked the foreman
solidly on the chin. The foreman
staggered back.
"You're fired P shouted the fore
man to the workman.
"Like hell I am." retorted the work
man. "I work for the telephone com

James Roosevelt last night recalled
the first birthday of "my boy, Frank
lin." While the nation celebrated his
fifty-second birthday annlveraary, the
President's mother remembered the
sunny upstairs room in their home on
the Hudson the room where Frank
lin wa born.
It came near being a dark day
that January dny 63 years ago. For,
as the President's mother recslled In
her book published last year, "when
he wa born I was given too much
chloroform, and It was nearly fatal
to us both.
"The nurse said she never expected
the baby to be alive, and was sur
prised to find that he was."
He was born in their own horns
the long, rambling house at Hyde
Park to which ara Delano ea.me as

in those days.

Judge Alexander Akerman today de
clared the Agricultural Adjustment
Act unconstitutional and Issued ft

injunction restraining the state con
trol committee from enforcing prora
tion orders.
In an oral order from the bench at
the conclusion of a two-day hearing
on Injunction proceedings brought by
the Hillsborough Packing company
and Lake Ferns Groves, Inc., Judge
Akerman said the act when consid
ered In the light of the constitution
"Is so full of holes you could drlre
eight yoke of oven through It."
Can't Avoid Decision.
"I would be more than happy if I
could avoid deciding the questions
presented In this case, but if I did
I'd be a coward," he said. Adding that
public clamor and threats could not
deter him from ruling as he saw ths
matter.
Declaring that he read the consti
tution once a- week, but could find
no reference in It to the department
of agriculture, the Judge said the
secretary of agriculture had become
such a great power that he had an
army of men greater than George
Washington, and today had more
power than Caesar or Napoleon, "snd
nil without constitutional authority.

Akerman dismissed the bill as It per
tains to Secretary Wallace. The gov
ernment had moved for this action,
on the grounds that Wallace was not
a resident of the district and there

for the control committee declined
to comment, but indicated the case
would be appealed.
