erett Battles, released from the Ma
rion county Jail by Sheriff A. C.
Burk after serving only 139 days of
a sentence of one year, today sur
rendered himself to serve out the
remainder of his term or remain in
Jail until such time as the contro
versy over his allegedly Illegal release
hM been settled.
SALEM. Ore.. Jan. 19. (AP) Judge
L. H. McMahan of the Marlon county
circuit court today Instructed the
grand Jury to investigate the action
of Sheriff A. C. Burk in releasing
Everett Battles from the county Jail
prior to the expiration of his mini
mum term.
In his instructions the Judge also
charged the Jury to Inquire into the
bills rendered by the sheriff against
MArlon county for the operation of
Automobiles. "
Battles, sentenced to serve a year
in Jail upon conviction as a hit-and-run
driver of a car which struck
and caused the death of Wah Hong,
aged Chinese, was released from cus
tody on Januay 6 after having served
only 139 days of his term, during
nil of which time ne was a trusty.
Given credit for all "sood time" al
lowances permitted by law he would
have served 281 days. Judge McMa
han advised the" Jurors.
Citing section 31-401, Oregon code,
the instructions point out that any
prisoner committed to the county
Jail 'Viall be actually confined" in
the Jail until he la legally discharged,
ani that the sheriff or Jailer per
mitting his release otherwise it
ftullty Af- a misdemeanor. Convic
tion under the statutes carries with
it the penalty of dismissal from of
fice, impeachment for not more than
one year, a fine of not more than
500 or both fine and imprisonment.
Streslng the point that prisoners
hall actually be confined in Jail,
the instruction charee "that Mr.
Battles not only was at no lime con
fined In Jail, but that he has been
given rides to Sllverton in a car for
his pleasure and recreation."
