, Banks, in the bill of exceptions, al
leles that the oourt erred In Its in
structions to the Jury, that a womso
bailiff was guilty of misconduct, In
talking to women Jurors during the
trial, that the stats Introduced a pis
tol as evidence and the assistant attorney-general's
language, In hi clos
ing address to the Jury, was preju
dicial to Defendant Banks.
The pistol was found In the Banks
home after the slaying, on a settee.
The defense holds that It bad no
bearing on the oase, that Its owner
ship was never clearly established,
and that the murder was committed
with an "elephant gun" Banks ad
mitted firing.
; The defense alleges that the assist
ant attorney-general, In his closing
remarks, characterized Bank as "a
moral coward, hiding behind bis wife's
skirts." One of the defense counsol
likened him to Jesus Christ, and the
other to President Roosevelt.
The woman bailiff Is alleged to
have permitted women Jurora to tele
phone their families that they would
return home soon, after (he deliber
ations started.
Report to the. authorities recently
state that Banks was in tns prison
hospital for a day with a light cold,
but ha recovered. All the Jackson
oounty delegation at the penitentiary
were reported as reconciled to prison
routine. In good health and behav
ing themselves, all being now rated

TAX DUE DEC. 15
FORTLAND, Or. "The fourth
quarterly installment of income tax
(or the calendar year 1933 will be
due on or before midnight, Friday,
December 18, 1033," announced J. W.
-.Maloney, collector- of- Internal- reve
nue, today, "Notices have been sent
to the taxpayers, but failure to re
ceive a notice does not relieve a tax
payer of his obligation to pay the tax
on time. Interest will accrue at the
rate of 12 per cent 'per annum on
the unpaid balance."
'. The tax may be paid at the office
of Collector Maloney In the custom
house, Portland, or at branch offices
located In La Grande, Pendleton, Eu
gene, Salem, Klamath Pall and Med
ford. Payment may be made by cash,
money order or check- If made at a
branch office, payment should be
by check or money order to avoid
danger of loss In transmission to
the office of the collector. Checks
or money order should be made pay
able to the order of collector of In
ternal revenue, Portland, Oregon.

Nicholas Murray Butler last night
and In a champagne toast ac
claimed him, a the man "most
responsible for repeal."
Dr. Butler, president of Colum
bia University, described his long
campaign and termed national
prohibition "a phase of the rest
to persecute."
"Now It Is the responsibility of
the people of the United States
to show that they havo a much
sense as the peoples of Sweden,
Greet Britain and Canada," he
told the diners.

sons here are already looking with
covetous eyes toward the job of man
ager of the local liquor store, in the
belief that the Knox bill wlU be
adopted, it was reported In several
quarters.

to have petitions In circulation to
day, recommending his appointment.
Earl Foy, also Republican, and for
mer collector of Internal revenue, who
was recently succeeded In office by
Erie Oray, u also said to be & can
didate for the position.
The third, mentioned today was
William Truss, whose politics were
not revealed.
It Is understood that tt the Knox
bill Is passed that the appointment
of liquor store managers will be up
to Governor Julius L, Meier, who has
shown no fondness for Democrats up
to date In any of his appointment,
so the Bourbons have mentioned no
one for the position.
Frank DeSoura, chairman of the
Democratic central oommlttee, stated
this afternoon that he knew of no
Democrat seeking the Job, due to
put action of the governor.
A consignment of "osteo mylltla" Is
now eh rdute by ilr mall from New
York city, and will be used by Dr.
O. I. Drummond of the county health
department In the treatment of bone
tuberculosis. The "osteo mylltU," In
plain Engllah, are "blow fly" eggs.
The "osteo mylltls" are placed In
the bone. They eat away the decayed
portions of the diseased bone, and
leave the healthy areas. When this
is completed the bona heals, and ft
cure Is generally affected.
The treatment Is unusual, but not
rare. Three or four Jackson cases,
are now being treated by Medford
phyalolans.

Bop of Jackson authorities that
the special session of the legislature
would enact a law providing for the
destruction of slot machines, Waa
crushed this week, when the measure
failed to emerge from the "steering
committee."
The sheriff now holds four slot ma
chines, seised ten days ago In raids
on roadhouses and a country store,
under orders of the Justice court to
wait until a decision Is reached. The
present law provides for selnire, but
I Indefinite on destruction and con
fiscation. The opinion of the attor
ney general on confiscation 1 also
sought.
The slot machine Issue brought out
the bitterest attack of the legislative

Control of politician by slot
machine Interest and control of
th steering committee by gam
bling game operators was charged
on the floor of the house Tues
day by ita only woman member,
Hannah Martin. Mrs. Martin pre
olpltated the first spectacular
battle on the floor of the legis
lature this session with her at
tempt to force the steering com
mittee to report out one of her
bills.
The legislature is expected to con
sider further sctlon to end the mud
dle, before adjurnlng Saturday.
Two of the slot machine operators
were fined 936 each and coats. The
distributor waa fined 93ft and coata.
Both cases appeared before Justice
of the Peace William B. Coleman
last week. The fines were paid.
Early In October, the district at
torney and sheriff, a did official In
other counties of the state, started
a campaign against slot machines.
Most establlahmenta. with the de
vice on the counters, compiled with
the ban, but a few In rural sections
and roadhouaes, brought them back.
The second clean-up followed. Moat
of the gambling devices In this city
have since been kept closeted.

ceremoniously signed the women's
suffrage bill, which he urged the
Philippine legislature to adopt.
The law, effective January 1, 193B,
will make Filipino women the first
of their sex to enjoy the ballot In
the far east, '
FAILURE TO REPORT
ACCIDENT COSTS $10
Joseph Ortls of Klamath Palls was
fined elo and cost In justice court
this morning, for failure to report
an accident. Ortls allegedly ran into
a bank of sheep on the Crater Lake
highway October 38 last, killed three
of the sheep, and drove on without
reporting the mishap.

husband, Rudy Vallee, from seek
ing to obtain a divorce In a court
outside New Tork state was denied.

Burglar Was Polite
SEATTLE (UP) A polite burglar
entered the apartment of Harold
Pebbles attorney. Mrs. Pebbles heard
the door open and she shouted for
him to leave. "Beg pardon, madam."

departed.

BATTLE OFFICERS
XL PAASO. Texas, Deo. 8.(AP)
Three men were killed and another
was wounded In a battle between
U. S. border patrolmen and liquor
smugglers here early today.
The dead:
Dor C. Melton. 81, U. 8. border
patrolman, shot through the heart.
Francisco Gonzalez, 36, Juares.
Hlginlo Peres, Juares.
American officers seised 150 gallons
of mixed liquors.
Melton came here In January from
Cony era, Georgia. His body will be
sent to Oonyers for burial.
Patrolmen said more smugglers may
have been killed. They saw two men
fall In the river during the battle,
and are looking for the bodies. They
may have been the men who are
dead at Liberty hospital, .Juares.
The battle started when Melton and
five other inspectors challenged 18
men who had waded the river with
150 gallons of liquor. .
The smugglers had Just reached
the American side when the officers
leaped out of hiding with drawn
guns. ,
A blase of gunfire met their com
mand to surrender. Melton fell, shot
through the heart, at the first volley.
The other Inspectors returned the
fire aa the smugglers dropped their
loads snd backed Into the river, fir
ing as they retreated.
Beventy-four miles of pear trees
and 31 miles of peach treea are be
ing cultivated In a single orchard In
northern Italy.

In administration sources to be ex
peoted by President Roosevelt to have
work by December 18, under the Civil
Works administration.
