WHEREAS by Ordinance of the Cltv
Council of the City of Medford. Ore
gon, there was duly submitted to the
legal voters of said City at the special
city election held In and for said City
on tne autn day of June, 1933, tne
following charter amendment amend
ing Section 73 of the Charter of the
City of Medford, to read as follows:
Section 73.
(a) In the event that the Council
shall deem it for the best interest of
the eald City, the aald Council la
hereby authorized to Issue the bonds
of said City to refund any bonds or
warrants Including bonda Issued pur
suant to application to pay assess
ment In Installment, now outstand
ing, or any aucn warrants or bonda
that may hereafter be lawfully Issued
snd outstanding. The refunding bonds
herein authorized ahall not exceed In
the aggregate the par amount of the
warrants or bonda to be paid, redeem
ed or replaced and such refunding
oonaa sn&u not provide for a rate 01
Interest thereon In excess of 6 per
annum payable semi-annually. In the
event the said Council shall be un
able to sell any of the refunding bonda
herein authorized at the par amount
thereof and accrued Interest, the aald
Council la authorized to exchange any
or all auch refunding bonds for any
or all the bonds or warrants to be
refunded. Provided, however, that In
no event shall the par value and ac
crued interest of any refunding bonds
so exchanged exceed the par value
plus accrued interest of any of the
bonds or warrants to be refunded and
exchanged therefor.
(b) All refunding bonda issued un
der this act ahall be In serial form
with definite maturities and shall
mature in annual or eeml-annual In
stallments. The first installment of
principal shall become due and pay
able not later than five years from the
date of Issue and the last installment
shall become due and payable not
later than twenty years from the dRte
of Issue. The Installments of prin
cipal shall either be equal or sub
stantially equal In amount to the
combined Installment of principal
and interest due In any year shall be.
as nearly aa practicable, in such sums
as will permit of an equal annual tax
levy for the retirement of the prin
cipal of and the -payment of the In
terest on said bonds.
