The superstitious In many Portuguese
villages, ttrmly believing the heavens
were falling, rushed Into the streets
last night during a meteor display
which lasted several hours.
The church bells were tolled In
some villages and processions of peni
tents who carried lighted candles and
sang hymns were organized. Others
asked tor mercy from heaven.
Lisbon Itself did not view the show
due to a fog.

The chances are 99 In 100 that the
rain of falling stars In Europe last
night Is a shower of space -wandering
stonea which tho earth never encoun
tered before, according to Dr. Charles
P. Olivier, astronomer of the Univer
sity of Pennsylvania.
Whether this stream of meteoric
atones la so large that the earth la
still within Its borders with possibili
ties of more meteoric displays tonight
he said, Is not certain but seems un
likely. The European showers lasted about
two hours. Just after sunset, and
when word of them waa flashed to
Dr. Olivier, head of tbe American
Meteor society, he had the heavens
watched for hours. He bad not re
ceived a report of even one meteor
sighted on this side of the Atlantic.
This, he said. Indicated that prob
ably the shower waa over completely
within a very short time after It first
appearance. This complete termina
tion could arise from the fact that
the stream of flying stones waa small,
or If It waa a wide stream, then the
earth may have cut through only a
email section of the meteor pathway.
Not in hundreds of years, said Dr.
Olivier, has such a great shower of
meteors appeared anywhere near this
date In October.

IN FINAL STAGES
The tentative 1934 budget for
Jackson county will be completed
late today by the budget committee,
who' toiled until two o'clock this
morning, to make It ready for publi
cation, as required by law, by October
12. The budget under a law passed
by the last legislature, must be com
pleted and finally approved by No
vember 1. Compiling of the final
figures la underway.
Members of the budget committee,
composed of O. O. Alenderfer, chair
man, Fred Wahl, George Alford, and
the county court, said that the
budget "in the main would be the
same as last year."
Provision In the budget Is made for
absorption of deficits In the budget
clue to agitation and commissary ex
travagance. The deficit amounts to
143.000, in round figures.
One of the chief problems of the
budget committee was to provide for
county office operation, handicapped
by the "economy" of the last budget
committee, when It arbitrarily cut the
"fixed overhead" of county offices.

the budget figures.
The county commissary caused an
outlay of more than 914,000, when
food waa dispensed practically to "all
comers" last winter.
The turmoil trials also dented the
county exchequer, particularly tthe
changes of venue trials granted L. A.
Banks and E. H. Fehl. The proceed
ings exhausted the circuit court,
sheriff's office, and clerk's office
funds.
The 1934 'budget, the committee
ssld. was "compiled on economy, con
sistent with sound business."

To Weigh Provocation.
The court ruled that in passing
sentence, it would weigh alleged prov
ocative matters, but' they had no
place In the trial. Articles written
and published by Hall were Intro
duced as evidence by the defense, to
this end, but were excluded by the
court, on the ground that the only
thing the Jury was to decide was
whether or not the crime charged
had been committed.
Hall on the stand as tho final state
witness, testified that Pitch took him
by the arm. when he left the News,
and Mrs. Martin approached htm wit!,
the whip. Hall testified he did not
know for "certain" Mrs. Martin was
"waiting for him" until the assault
occurred.
Mrs. M art In. with her mother, fatn
er and husband, were In court when
the verdict was returned. They re
ceived It calmly. The defendant
counselled frequently with her attor
ney, W. E. Phlpps, in the conduct of
the case.
GETS UNDER WAY
C. H. Brown, secretary of the "Good I
Government Congress." and active I
figure on the sidelines In the Banka
rhl turmoil, went on trial in circuit
court this morning, charged with
"slandering a bank." Brown, a de
fendant in the trial of his daughter.
Henrietta B. Martin, for "riotous con
duct." was acquitted on a directed
verdict.
Selection of a Jury was underway
this morning, and the case Is expected
to be In the hands of the Jmy late
today.
Brown Is alleged to have caused to
be printed In the Pacific Record-Herald.
March 2 last, an article, over h.s
signature, reflecting on the Farmers
and Fruitgrowers bank of this city.
The article, containing less than 100
words, implied that the bank was not
observing the national bank mora
torium, and that money was trans
ferred from the side doors, while a
moratorium notice was posted on the
front door.
The state holds the article was a
gratuitous contribution by Brown
3. O. Burgdorff, assiciate editor; Mrs.
Janet Ouches, occupying a secretarial
position In the weekly. Fred Wahl.
cashier of the bank, and William Lyd
lard, a depositor, will be called as
state witnesses.
Brown la scheduled to be the only
witness In his own behalf. He la rep

and W. E. Phlpps.
Circuit Judge H. D. Norton ordered
Brown to trial late yesterday, follow
ing the Interposing of continuance
motions by Brown's counsel, on the
grounds that Glen R. Jacks of Ore
gon City was unable to be present, to
act as "counsel-ln-chlef." The court
held that an affidavit of prejudice
filed by Brown. October 5, was not
within the statutory time.

was irreated In Memphis, Tenn.,
the day after. Kelly's apprehension
there. Officers aald Ramsey con

ey, however, was taken by federal
operatives and Ramsey returned to

ERMERHORN'S
TRIAL PLEA
HAS OPPOSITION
The attorney general's office has
filed a memorandum opposing the
plea of Gordon L. Schermerhorn, for
mer sheriff, for further extension of
time for filing an appeal to the state
supreme court, In his conviction for
ballot theft.
An affidavit signed by Jessie Nastln
court reporter, accompanies the mem
orandum, setting forth that no order
has been filed with her for a tran
script. The affidavit states that she
gave counsel an estimate of the cost
of the transcript at 585, but no fur
ther action has been taken.
The memorandum cites that there
Is no legitimate basis for a further
extenalpn, that no application has
been made for a transcript, that the
time for filing the appeal has expired,
that there baa been "Inexcusable
neglect," and the defendant Is "not
entitled to the Indulgence of the
court, by reason of having attempted
to Impose upon the court, by false
statement of fact."
Schermerhorn was convicted by a

tence, declared "this Is one of the
most painful duties of my career,"
and assured Schermerhorn that when
he had served his minimum time and
was eligible for parole, the court
would intercede. All the leading co-
defendants of Schermerhorn are now 1
serving prison sentences. Schermer
horn la at liberty on $7500 bonds.
Decision on the extension motion la
pending before Judge Sklpworth.
Formal notice of appeal to the state
supreme court has been filed with
the county clerk, for L. A. Banks,
former local disturber, serving life for
murder, by his attorneys. Charles B.
Hardy of Eugene, and Frank J. Loner
gan of Portland.
Appeal notice has also been filed
for Walter J. Jones, former mayor of
Rogue River, serving a state prison
sentence of four yeara for vote-stealing
conviction.
