John Olenn of Ashland, former
county Jailer, on trial for ballot theft,

assist "In getting rid of the ballots,"
the Sexton brothers testified Tuesday
afternoon, but Glenn wss poor pay.
For Burley Mason Sexton, 30. received
only SI and Wilbur, 17, received only
50 cents, the brothers said.
Burley Sexton further testified that
' while In the city Jail he phoned Olenn
at the county Jail, asking for bis
promised money, "as I needed shoes
and a lawyer." The defendant made
no definite reply, and Sexton ad
mitted he told him: "I've got you
in a tight spot."
Got SO Cents for Tobacco.
Wilbur testified he asked Olenn for
the money, and the ex-Jailer said "he
couldn't pay It till the first." He
' then received 50c for tobacco.
The two brothers, who testified to
the same set of facta In the LaDleu
and Jones trials, remained unshakr
under cross-examination. They linked
Brecheen, Suspended Sheriff Scher
merhorn and Oliver Martin, co-defendants,
anew and brought In the
names of Robert Bell, Janitor, and
Clark Thomaa of Ashland, former as
. slstant Jailer.
Burley Sexton testified that on the

' Olenn Wanted Credit.
"Later Olenn told us not to tell
Clsrk Thomas about It. because
Thomas thought Olenn did It all,"
Burley Sexton testified. "I guess he
wanted all the credit."
Wilbur Sexton testified that he
went Into Janitor Robert Bell's office
and Glenn said to him: "Keep still!
Bob don't know anything."
The Sexton brothers both teetlfled
that at a gathering In the county Jail
en February 23 last, two days after
the vote-stealing with Schermerhorn,
Glenn, Brecheen, Janitor Joe Daniels,
and Assistant Jailer Clark Thomaa
present, the conversation turned to
the ballot robbery, and Glenn said:
"It Is a hell of a way to build a
vault, with an Iron door In front,
and a glass window tn the back."
Those present laughed at the wise
crack. Olenn also Joked about The
Mall Tribune account of the robbery,
at Another nolnt. Wilbur Sextoji
said Glenn asked Schermerhorn:
How come the state police are ln
X vestlgatlng." and Joe Danlela ans
' wered: "It's some of George Carter's
(county clerk) work."
Told to Sit Tight.
Olenn told the brothers "to swear
In court that he gave them the 10
to pay for house rent," and advised
them "to sit tight and keep still, and
they won't find anything out."
The Sextons testified they had
heard courthouse rumors the ballots
would be destroyed, but thought It
was Just talk." until Olenn presented
his proposition.
"Olenn hid out during the robbery,"
Burley testified. "He said If any
body wanted him, he would be In the
Jail or at the 'Congress, and asld he
wss going to keep out of sight."
Under cross-examination the de
fense desired to know why this evi
dence had not been given at Ihe La
Dleu and Jones trials. The court ln
timinuri tji inr it was because a de
fense objection to Its Introduction
had been sustained.
When Attorney Von Schmala and
Moody engaged In an exchange, the
court said: "Counsel will stop quar
reling." Brecheen Hold Orders.
The Sextons testified that Olenn
told them "to go see Brecheen and
he will tell you boys what to do."
They also testified that Brecheen
ate supper and breakfast at- the Jail
table on the day of the robbery.
R. C. Cummlngs of Rogue River,
one of the defendanta who pleaded
guilty, told how he hsd started his
Ford to mske a noise while the "Con
