The defense counsel said he would

and talked with him until 10 o'clock

the county Jail and retired, and

cused went to sleep and did not

Assistant Attorney General Moody.
In his opening statement, said:
"The state will ehow that on the
night of the ballot robbery John
Olenn was so nervous that he kept
iolng to the Jail windows to see
what was going on and that he was
so perturbed that he forgot to lock
up the prisoners In their cells until
far paal the regular hour."
Attorney Moody also declared the

destruction of the ballots was dis
cussed; that h enacted a leading
role, and reviewed bis part not only
as told from the witness stand In
the LaDleu and Jones cases, but
hinted at new evldenos.

not only beyond a reasonable doubt

"We will show by witnesses who
stood outside the court house that

around, and In and out of the Jail,
with a private key."
Attorney Moody said that the state
would prove a conspiracy to destroy
the ballots to prevent a recount,
and that L. A. Banks and his wife
were scheduled as the "alibi mak
ers.' The first witnesses for the state
were called yesterday afternoon. They
were County 'Clerk George R. Carter
and Deputy Clerks Nydah Nell and
Helen Dugan. They testified, as In
former trials, to the existence of the
court house and vault, and to the
stolen ballots and preliminary details
of the case.
The court overruled a defense plea
for relntroductlon of their plea of
former Jeopardy.
